Bill Title: Amends the State Finance Act. Creates the Opioid Settlement Fund as a special fund in the State Treasury to receive opioid-related settlement funds to which the State of Illinois may be entitled under any opioid-related settlement. Provides that all funds received by the State from an opioid-related settlement shall be deposited into the Opioid Settlement Fund to be used for purposes related to alleviating the opioid crisis. Further specifies the use of moneys in the Fund. Defines terms. Effective immediately.

1 AN ACT concerning finance.
2 Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
4 Section 5. The State Finance Act is amended by adding
5Sections 5.935 and 6z-124 as follows:
6 (30 ILCS 105/5.935 new)
7 Sec. 5.935. The Opioid Settlement Fund.

10 (a) The Opioid Settlement Fund is created as a special
11fund in the State Treasury to receive opioid-related
12settlement funds to which the State of Illinois may be
13entitled under any opioid-related settlement.
14 (b) All funds received by the State from an opioid-related
15settlement shall be deposited into the Opioid Settlement Fund
16to be used for purposes related to alleviating the opioid
17crisis.
18 (c) Of the moneys allocated to the Fund, a portion shall be
19dedicated as follows: (i) to provide greater access to and
20availability of quality and effective opioid use disorder
21treatment; (ii) to provide funding to safety net substance use
22treatment providers, including the allocation of capital

1funding resources to such providers to expand access to and
2availability of quality and effective opioid use disorder
3treatment; and (iii) to maximize the opportunity to draw
4federal matching funds for purposes related to alleviation of
5the opioid crisis.
6 (d) In addition to the moneys allocated under subsection
7(c), subject to appropriation, at least $100,000 shall, on an
8annual basis, be granted to the Illinois Alcohol and Other
9Drug Abuse Professional Certification Association to cover the
10fees associated with the application and testing of human
11services professionals in the State of Illinois who provide
12substance use disorder services and mental health services.
13 (e) For the purposes of this Section:
14 "Opioid-related settlement" means any and all current or
15future settlements reached by the State of Illinois,
16independently or as part of a global or multi-state
17settlement, with opioid manufacturers, distributors,
18retailers, and any associated business entities.
19 "Safety net substance use treatment providers" means
20licensed substance use treatment providers that are open 24
21hours per day and provide medication-assisted treatment to
22individuals with opioid use disorder.
23 Section 99. Effective date. This Act takes effect upon
24becoming law.
