AN ACT concerning local government.
Be it enacted by the People of the State of Illinois,
represented in the General Assembly:
Section 5. The Public Officer Prohibited Activities Act is
amended by adding Section 4.1 as follows:
(50 ILCS 105/4.1 new)
Sec. 4.1. Non-disclosure agreements.
(a) As used in this Section, "tax incentive" includes, but
is not limited to, any tax incentive authorized by law that by
exemption, exclusion, deduction, allowance, credit,
preferential tax rate, abatement, or other device reduces the
amount of tax revenues that would otherwise accrue to the unit
of local government.
(b) No officer, employee, or agent of a unit of local
government may attempt to withhold disclosure to the public of
information relating to tax incentives and other financial
incentives by using a non-disclosure agreement.
Section 99. Effective date. This Act takes effect upon
becoming law.
