AN ACT concerning employment.
Be it enacted by the People of the State of Illinois,
represented in the General Assembly:
Section 5. The Job Opportunities for Qualified Applicants
Act is amended by adding Section 17 as follows:
(820 ILCS 75/17 new)
Sec. 17. Do-not-hire lists.
(a) An employer or employment agency that maintains a
do-not-hire list may not include an individual on that list
unless the individual has committed a violent crime or unless
the specific employment opportunity requires the employee to
exercise fiduciary responsibility.
(b) An employer or employment agency that maintains a
do-not-hire list must annually reevaluate the persons on the
list to ascertain whether the persons should remain on the
list.
(c) In this Section, "violent crime" has the meaning
ascribed to that term in the Rights of Crime Victims and
Witnesses Act.
