Bill Title: Amends the Secretary of State Merit Employment Code, the Comptroller Merit Employment Code, the State Treasurer Employment Code, and the Personnel Code. Provides that preferences shall be granted to qualified persons with disabilities in entrance examinations for employment positions under the separate Acts. Provides that the preference shall be in the form of points added to the final grades of the persons if they otherwise qualify and are entitled to appear on the list of those eligible for appointments.

AN ACT concerning State government.
Be it enacted by the People of the State of Illinois,
represented in the General Assembly:
Section 5. The Secretary of State Merit Employment Code is
amended by adding Section 10b.7.5 as follows:
(15 ILCS 310/10b.7.5 new)
Sec. 10b.7.5. Persons with disabilities preference. For
the granting of appropriate preference in entrance
examinations to qualified persons with disabilities and to
certain other persons as set forth in this Section.
(a) As used in this Section:
(1) "Person with a disability" means a person who is a
citizen or lawful resident of the United States and is a
person qualifying as being disabled.
(2) "Disabled" means a severe physical or mental
disability that:
(A) results from amputation, autism, blindness,
burn injury, cancer, cerebral palsy, Crohn's disease,
cystic fibrosis, deafness, head injury, hemiplegia,
hemophilia, respiratory or pulmonary dysfunction,
mental retardation, mental illness, multiple
sclerosis, muscular dystrophy, musculoskeletal
disorders, neurological disorders, including stroke

and epilepsy, paraplegia, quadriplegia and other
spinal cord conditions, sickle cell anemia, specific
learning disabilities, or end stage renal failure
disease; and
(B) substantially limits one or more of the
person's major life activities.
Another disability or combination of disabilities may
also be considered as a severe disability for the purposes
of this Section if it is determined by an evaluation of
rehabilitation potential to cause a comparable degree of
substantial functional limitation similar to the specific
list of disabilities listed in subparagraph (A) of this
paragraph (2).
(b) The preference granted under this Section shall be in
the form of points added to the final grades of the persons if
they otherwise qualify and are entitled to appear on the list
of those eligible for appointments.
(c) A person with a disability is qualified for a
preference of 2 points.
(d) The rank order of persons entitled to a preference on
eligible lists shall be determined on the basis of their
augmented ratings. When the Director establishes eligible
lists on the basis of category ratings such as "superior",
"excellent", "well qualified", and "qualified", the eligibles
with disabilities in each such category shall be preferred for
appointment before the eligibles without disabilities in the

same category but not before veteran eligibles in that category
preferred under Section 10b.7.
(e) The Director shall adopt rules and implement procedures
to verify that any person seeking a preference under this
Section is entitled to the preference. A person seeking a
preference under this Section shall provide documentation or
execute any consents or other documents required by the
Director to enable the Director to verify that the person is
entitled to the preference.
Section 10. The Comptroller Merit Employment Code is
amended by adding Section 10b.7.5 as follows:

persons as set forth in this Section.

Services or any other State department or agency to enable the
department or agency to verify that the person is entitled to
the preference.
