AN ACT concerning finance.
Be it enacted by the People of the State of Illinois,
represented in the General Assembly:
Section 5. The Business Enterprise for Minorities,
Females, and Persons with Disabilities Act is amended by adding
Section 8k as follows:

Sec. 8k. Credit program. Thirty days after the effective
date of this amendatory Act of the 101st General Assembly, the
Department of Central Management Services, in conjunction with
the Council, shall establish a credit program where contractors
may receive credit applicable to meeting the requirements of
this Act based on their utilization of minority owned
businesses and female owned businesses. The credit program
shall be reviewed annually by the Department of Central
Management Services and the Council and may be suspended by the
Department upon a finding of substantial evidence of fraud in
connection with the application for credits. The credit program
shall include the following features:
(1) Credits shall be awarded by the board only for the
use of minority owned businesses or female owned businesses
in projects which do not have affirmative action goals
mandated by law or contract or to the extent of use in

excess of such mandated affirmative action goals.
(2) $1 of credit shall be earned for each $3 of
eligible use.
(3) Credits shall be awarded only to the party
responsible for hiring the minority owned business or
female owned business, and if there is more than one
responsible party, credits shall be allocated pro rata
among such parties in order to prevent duplication.
(4) Credits may be applied at the time a contract is
awarded against the requirements set forth in this Act to
reduce the requirements, dollar of requirement for dollar
of credit, up to a maximum credit of 5% of the dollar value
of the contract.
(5) Credits may not be applied more than one year after
being awarded by the Department.
