Bill Title: Amends the Downstate Police Article of the Illinois Pension Code. Provides that, if a special needs trust has been established for a disabled adult child, then the special needs trust may stand in lieu of the disabled adult child as a beneficiary for the purposes of the Article. Effective immediately.

| 1 | AN ACT concerning public employee benefits.
| ||||||
| 2 | Be it enacted by the People of the State of Illinois,
| ||||||
| 3 | represented in the General Assembly:
| ||||||
| 4 | Section 5. The Illinois Pension Code is amended by changing | ||||||
| 5 | Section 3-108.3 as follows:
| ||||||
| 6 | (40 ILCS 5/3-108.3)
| ||||||
| 7 | Sec. 3-108.3. Beneficiary. "Beneficiary": A person | ||||||
| 8 | receiving benefits from
a pension fund, including, but not | ||||||
| 9 | limited to, retired pensioners, disabled
pensioners, their | ||||||
| 10 | surviving spouses, minor children, disabled children, and
| ||||||
| 11 | dependent parents. If a special needs trust as described in | ||||||
| 12 | Section 1396p(d)(4) of Title 42 of the United States Code, as | ||||||
| 13 | amended from time to time, has been established for a disabled | ||||||
| 14 | adult child, then the special needs trust may stand in lieu of | ||||||
| 15 | the disabled adult child as a beneficiary for the purposes of | ||||||
| 16 | this Article.
