Bill Title: Amends the Downstate Police Article of the Illinois Pension Code. Provides that, if a special needs trust has been established for a disabled adult child, then the special needs trust may stand in lieu of the disabled adult child as a beneficiary for the purposes of the Article. Effective immediately.

1 AN ACT concerning public employee benefits.
2 Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
4 Section 5. The Illinois Pension Code is amended by changing
5 Section 3-108.3 as follows:
6 (40 ILCS 5/3-108.3)
7 Sec. 3-108.3. Beneficiary. "Beneficiary": A person
8 receiving benefits from a pension fund, including, but not
9 limited to, retired pensioners, disabled pensioners, their
10 surviving spouses, minor children, disabled children, and
11 dependent parents. If a special needs trust as described in
12 Section 1396p(d)(4) of Title 42 of the United States Code, as
13 amended from time to time, has been established for a disabled
14 adult child, then the special needs trust may stand in lieu of
15 the disabled adult child as a beneficiary for the purposes of
16 this Article.

18 Section 99. Effective date. This Act takes effect upon
