Bill Title: Amends the Illinois Service Member Civil Relief Act. Provides that any person or service member who enters military service may, at any time after receiving military orders to relocate for a period of service of at least 90 days, terminate or suspend certain specified contracts for service. Provides that termination or suspension of a contract must be made by delivery of a written or electronic notice, along with a copy of the service member's official military orders calling him or her to military service, to the specified service provider. Provides that a termination or suspension of service is effective on the day notice is given. Provides that a service member who terminates or suspends a contract for services, and who is no longer in active military service, may reinstate the provision of service upon providing written or electronic notice to the service provider that he or she is no longer on active military service. Provides that nothing shall be construed to conflict with the provisions of the federal Servicemembers Civil Relief Act, or any other applicable provision of the Act.

1 AN ACT concerning veterans.
2 Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
4 Section 5. The Illinois Service Member Civil Relief Act is
5amended by adding Sections 13 and 85 as follows:
6 (330 ILCS 63/13 new)
7 Sec. 13. Contract termination.
8 (a) Any person or service member who enters military
9service may, at any time after receiving military orders to
10relocate for a period of service of at least 90 days, terminate
11or suspend any of the following contracts for services:
12 (1) internet services;
13 (2) television and cable services;
14 (3) athletic club or gym memberships; and
15 (4) satellite radio services.
16 (b) Termination or suspension of a contract under this
17Section must be made by delivery of a written or electronic
18notice, along with a copy of the service member's official
19military orders calling him or her to military service, to the
20specified service provider. A termination or suspension under
21this Section is effective on the day notice is given under this
22subsection (b). A service member who terminates or suspends a
23contract for services under this Section, and who is no longer

1in active military service, may reinstate the provision of
2service upon providing written or electronic notice to the
3service provider that he or she is no longer on active military
4service.
5 (c) Nothing in this Section shall be construed to conflict
6with the provisions of the federal Servicemembers Civil Relief
7Act, or any other applicable provision of this Act.
8 (d) The provisions of this Section shall only apply to
9contracts entered into on and after the effective date of this
10amendatory Act of the 100th General Assembly.

12 Sec. 85. Violations. A violation of this Act constitutes an
13unlawful practice under the Consumer Fraud and Deceptive
14Business Practices Act.
15 Section 10. The Consumer Fraud and Deceptive Business
16Practices Act is amended by changing Section 2Z as follows:
17 (815 ILCS 505/2Z) (from Ch. 121 1/2, par. 262Z)
18 Sec. 2Z. Violations of other Acts. Any person who knowingly
19violates the Automotive Repair Act, the Automotive Collision
20Repair Act, the Home Repair and Remodeling Act, the Dance
21Studio Act, the Physical Fitness Services Act, the Hearing
22Instrument Consumer Protection Act, the Illinois Union Label
23Act, the Job Referral and Job Listing Services Consumer

1Protection Act, the Travel Promotion Consumer Protection Act,
2the Credit Services Organizations Act, the Automatic Telephone
3Dialers Act, the Pay-Per-Call Services Consumer Protection
4Act, the Telephone Solicitations Act, the Illinois Funeral or
5Burial Funds Act, the Cemetery Oversight Act, the Cemetery Care
6Act, the Safe and Hygienic Bed Act, the Pre-Need Cemetery Sales
7Act, the High Risk Home Loan Act, the Payday Loan Reform Act,
8the Mortgage Rescue Fraud Act, subsection (a) or (b) of Section
93-10 of the Cigarette Tax Act, subsection (a) or (b) of Section
103-10 of the Cigarette Use Tax Act, the Electronic Mail Act, the
11Internet Caller Identification Act, paragraph (6) of
12subsection (k) of Section 6-305 of the Illinois Vehicle Code,
13Section 11-1431, 18d-115, 18d-120, 18d-125, 18d-135, 18d-150,
14or 18d-153 of the Illinois Vehicle Code, Article 3 of the
15Residential Real Property Disclosure Act, the Automatic
16Contract Renewal Act, the Reverse Mortgage Act, Section 25 of
17the Youth Mental Health Protection Act, or the Personal
18Information Protection Act, or the Illinois Service Member
19Civil Relief Act commits an unlawful practice within the
20meaning of this Act.
