Bill Title: Amends the Illinois Municipal Code. Provides that the corporate authorities of a municipality may fix, charge, and collect fees not exceeding the reasonable cost of the service for all emergency services rendered by the municipality against persons, businesses, and other entities who are not residents of the municipality. Specifies that the fee shall be computed at a rate not to exceed $250 per hour for emergency assistance. Provides that no fee shall be imposed for fire and rescue services when the total cost is less than $50. Effective immediately.

| 2 | AMENDMENT NO. ______. Amend House Bill 1981 by replacing | ||||||
| 3 | everything after the enacting clause with the following:

| 4 | "Section 5. The Property Tax Code is amended by adding | ||||||
| 5 | Section 3-70 as follows:
| ||||||
| 6 | (35 ILCS 200/3-70 new) | ||||||
| 7 | Sec. 3-70. Cessation of Township Assessor. If the office of | ||||||
| 8 | Township Assessor in a coterminous township ceases as provided | ||||||
| 9 | in Section 25-30 of the Township Code, then the coterminous | ||||||
| 10 | municipality shall assume the duties of the Township Assessor | ||||||
| 11 | under this Code.
| ||||||
| 12 | Section 10. The Township Code is amended by changing | ||||||
| 13 | Section 50-20 and by adding Section 25-30 as follows:
| ||||||
| 14 | (60 ILCS 1/25-30 new) | ||||||

| 1 | Sec. 25-30. Discontinuance of a coterminous township. | ||||||
| 2 | (a) Notwithstanding any provision of Section 25-10 to the | ||||||
| 3 | contrary, the board of trustees of a coterminous township may, | ||||||
| 4 | by ordinance, submit a proposition to discontinue township | ||||||
| 5 | organization to the electors of the township at a general | ||||||
| 6 | election or consolidated election in accordance with general | ||||||
| 7 | election law. | ||||||
| 8 | The proposition shall be in substantially the following | ||||||
| 9 | form: | ||||||
| 10 | Shall the township organization be continued in (name | ||||||
| 11 | of township)? | ||||||
| 12 | The votes shall be recorded as "Yes" or "No". | ||||||
| 13 | If it appears by the returns of the election that a | ||||||
| 14 | majority of the votes of the township cast on the question of | ||||||
| 15 | the continuance of township organization at the election are | ||||||
| 16 | against the proposed option for continuance, then township | ||||||
| 17 | organization shall cease in the township on January 1 of the | ||||||
| 18 | calendar year immediately following the calendar year that the | ||||||
| 19 | proposition was approved by the electors. Upon discontinuance | ||||||
| 20 | of township organization, all powers, duties, assets, | ||||||
| 21 | property, liabilities, obligations, and responsibilities of | ||||||
| 22 | the township shall be assumed by the coterminous municipality. | ||||||
| 23 | (b) If it appears by the returns of the election that a | ||||||
| 24 | majority of the votes of the township cast on the question of | ||||||
| 25 | the continuance of township organization are against | ||||||
| 26 | continuance, then the office of Township Supervisor and the | ||||||
| |||||||
| |||||||
| 1 | office of Township Assessor shall cease in the township at the | ||||||
| 2 | next January 1 after the proposition was approved. If the | ||||||
| 3 | office of Township Supervisor ceases, then the coterminous | ||||||
| 4 | municipality shall assume the duties of Township Supervisor. If | ||||||
| 5 | the office of Township Assessor ceases, then the coterminous | ||||||
| 6 | municipality shall assume the duties of the Township Assessor | ||||||
| 7 | under the Property Tax Code and the Public Health District Act. | ||||||
| 8 | (c) The coterminous municipality shall assume all taxing | ||||||
| 9 | authority of the township abolished under this Section. For | ||||||
| 10 | purposes of distribution of revenue, the coterminous | ||||||
| 11 | municipality shall assume the powers, duties, and obligations | ||||||
| 12 | of the township. | ||||||
| 13 | (d) Upon discontinuance of township organization, the | ||||||
| 14 | records of the township shall be deposited in the city clerk's | ||||||
| 15 | office. The coterminous municipality may close up all | ||||||
| 16 | unfinished business of the township and sell and dispose of any | ||||||
| 17 | of the property belonging to the township, as fully as might | ||||||
| 18 | have been done by the township itself, for benefit of the | ||||||
| 19 | inhabitants of the municipality. | ||||||
| 20 | (e) Nothing in this Section shall prevent the coterminous | ||||||
| 21 | municipality from entering into an intergovernmental agreement | ||||||
| 22 | or contract to provide for general assistance or property | ||||||
| 23 | assessment duties for services under its jurisdiction.

| 25 | Sec. 50-20. Counties with no township collector. No | ||||||
| |||||||
| |||||||
| 1 | collector in counties under 100,000. | ||||||
| 2 | (a) No collector in counties under 100,000. In counties | ||||||
| 3 | under
township organization, having a population of less than | ||||||
| 4 | 100,000, there shall be
no township collector elected. The | ||||||
| 5 | county collector shall be ex-officio
township collector, and | ||||||
| 6 | all the duties of the township collector shall devolve
upon and | ||||||
| 7 | be performed by the county collector.
| ||||||
| 8 | (b) No collector in counties over 2,000,000. In counties | ||||||
| 9 | having a population of more than 2,000,000 inhabitants there | ||||||
| 10 | shall be no township collector elected on and after the | ||||||
| 11 | effective date of this amendatory Act of the 97th General | ||||||
| 12 | Assembly. Upon the completion of the terms of office of | ||||||
| 13 | township collectors holding office on the effective date of | ||||||
| 14 | this amendatory Act of the 97th General Assembly, the township | ||||||
| 15 | assessor shall be the ex-officio township collector, and all | ||||||
| 16 | the duties of the township collector shall devolve upon and be | ||||||
| 17 | performed by the township assessor. | ||||||

| 19 | Section 15. The Public Health District Act is amended by | ||||||
| 20 | adding Section 25 as follows:
| ||||||
| 21 | (70 ILCS 905/25 new) | ||||||
| 22 | Sec. 25. Cessation of Township Assessor. If the office of | ||||||
| 23 | Township Assessor in a coterminous township ceases as provided | ||||||
| 24 | in Section 25-30 of the Township Code, then the city council | ||||||

| 1 | members of the coterminous municipality shall be the board of | ||||||
| 2 | health for the public health district under this Act.
| ||||||
| 3 | Section 20. The Illinois Public Aid Code is amended by | ||||||
| 4 | adding Section 12-3.1 as follows:
| ||||||
| 5 | (305 ILCS 5/12-3.1 new) | ||||||
| 6 | Sec. 12-3.1. Discontinuance of a coterminous township. | ||||||
| 7 | Upon discontinuance of a coterminous township, the coterminous | ||||||
| 8 | municipality shall provide funds for and administer the public | ||||||
| 9 | aid program provided for under Article VI of this Code.
| ||||||
| 10 | Section 99. Effective date. This Act takes effect upon | ||||||
| 11 | becoming law.".
