Bill Title: Amends the School Code. Provides that if, after 2 years following its placement on academic watch status, a school district or school remains on academic watch status, then the State Board of Education shall direct the school board to operate its schools or the school on a full-year school plan approved by the State Board of Education upon expiration of its teachers' current collective bargaining agreement. Requires the school board, in such a case, to devise a plan so that a student's required attendance in school shall be for a minimum term of 180 days of actual attendance, including not more than 4 institute days, during a 12-month period (now, the minimum term under a full-year school plan must also not exceed 185 days).

1 AN ACT concerning education.
2 Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
4 Section 5. The School Code is amended by changing Sections
52-3.25f and 10-19.1 as follows:
6 (105 ILCS 5/2-3.25f) (from Ch. 122, par. 2-3.25f)
7 Sec. 2-3.25f. State interventions.
8 (a) The State Board of Education shall provide technical
9assistance to assist with the development and implementation of
10School and District Improvement Plans.
11 Schools or school districts that fail to make reasonable
12efforts to implement an approved Improvement Plan may suffer
13loss of State funds by school district, attendance center, or
14program as the State Board of Education deems appropriate.
15 (a-5) In this subsection (a-5), "school" means any of the
16following named public schools or their successor name:
17 (1) Dirksen Middle School in Dolton School District
18 149.
19 (2) Diekman Elementary School in Dolton School
20 District 149.
21 (3) Caroline Sibley Elementary School in Dolton School
22 District 149.

20 If, after 2 years following its placement on academic watch
21status, a school remains on academic watch status, then the
22State Board of Education shall direct the school board to
23operate that school on a pilot full-year school plan approved
24by the State Board of Education upon expiration of its
25teachers' current collective bargaining agreement until the
26expiration of the next collective bargaining agreement.

1 (b) In addition, if after 3 years following its placement
2on academic watch status a school district or school remains on
3academic watch status, the State Board of Education shall take
4one of the following actions for the district or school:
5 (1) The State Board of Education may authorize the
6 State Superintendent of Education to direct the regional
7 superintendent of schools to remove school board members
8 pursuant to Section 3-14.28 of this Code. Prior to such
9 direction the State Board of Education shall permit members
10 of the local board of education to present written and oral
11 comments to the State Board of Education. The State Board
12 of Education may direct the State Superintendent of
13 Education to appoint an Independent Authority that shall
14 exercise such powers and duties as may be necessary to
15 operate a school or school district for purposes of
16 improving pupil performance and school improvement. The
17 State Superintendent of Education shall designate one
18 member of the Independent Authority to serve as chairman.
19 The Independent Authority shall serve for a period of time
20 specified by the State Board of Education upon the
21 recommendation of the State Superintendent of Education.
22 (2) The State Board of Education may (A) change the
23 recognition status of the school district or school to
24 nonrecognized, or (B) authorize the State Superintendent
25 of Education to direct the reassignment of pupils or direct
26 the reassignment or replacement of school district

1 personnel who are relevant to the failure to meet adequate
2 yearly progress criteria. If a school district is
3 nonrecognized in its entirety, it shall automatically be
4 dissolved on July 1 following that nonrecognition and its
5 territory realigned with another school district or
6 districts by the regional board of school trustees in
7 accordance with the procedures set forth in Section 7-11 of
8 the School Code. The effective date of the nonrecognition
9 of a school shall be July 1 following the nonrecognition.
10 (c) All federal requirements apply to schools and school
11districts utilizing federal funds under Title I, Part A of the
12federal Elementary and Secondary Education Act of 1965.

16 (a) Any school district may, by resolution of its board,
17operate one or more schools within the district on a full year
18school plan approved by the State Board of Education. Any board
19which operates under this subsection (a) Section shall devise a
20plan so that a student's required attendance in school shall be
21for a minimum term of 180 days of actual attendance, including
22not more than 4 institute days, during a 12 month period, but
23shall not exceed 185 days. Under such plan, no teacher shall be
24required to teach more than 185 days. A calendar of 180 days
25may be established with the approval of the State Board of

2 (b) Any school board that operates one or more schools
3within the school district on a pilot full-year school plan
4under subsection (a-5) of Section 2-3.25f of this Code shall
5devise a plan so that a student's required attendance in school
6shall be for a minimum term of 215 days of actual attendance,
7including not more than 4 institute days, during a 12-month
8period. A calendar of 215 days may be established with the
9approval of the State Board of Education.
