Amends the Illinois School Student Records Act. Provides that when a student transfers to a new school, the school or school district last attended may not refuse the new school's request to provide a copy of the student's school student record on the grounds that the student owes a debt.

1 AN ACT concerning education.
2 Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
4 Section 5. The Illinois School Student Records Act is
5amended by changing Section 8.1 as follows:
6 (105 ILCS 10/8.1) (from Ch. 122, par. 50-8.1)
7 Sec. 8.1. (a) No school may refuse to admit or enroll a
8student because of that student's failure to present his
9student permanent or temporary record from a school previously
10attended.
11 (b) When a new student applies for admission to a school
12and does not present his school student record, such school
13may notify the school or school district last attended by such
14student, requesting that the student's school student record
15be copied and sent to it; such request shall be honored within
1610 days after it is received, and under no circumstances may
17the school or school district last attended refuse the request
18on the grounds that the student owes a debt. Within 10 days
19after receiving a request from the Department of Children and
20Family Services, the school district last attended by the
21student shall send the student's school student record to the
22receiving school district.
23 (c) In the case of a transfer between school districts of a

1student who is eligible for special education and related
2services, when the parent or guardian of the student presents
3a copy of the student's then current individualized education
4program (IEP) to the new school, the student shall be placed in
5a special education program in accordance with that described
6in the student's IEP.
7 (d) Out-of-state transfer students may use unofficial
8transcripts for admission to a school until official
9transcripts are obtained from his or her last school district,
10including children of military personnel that transfer into
11this State, subject to Section 32 of the Educational
12Opportunity for Military Children Act.
