Bill Title: Amends the Consumer Fraud and Deceptive Business Practices Act. Provides that it is an unlawful practice for a person to impose a surcharge upon a consumer who elects to pay by use of a credit card instead of making payment by cash, check, or similar means of payment. Effective immediately.

| 1 | AN ACT concerning business transactions.

| 2 | Be it enacted by the People of the State of Illinois,

| 3 | represented in the General Assembly:

| 4 | Section 5. The Consumer Fraud and Deceptive Business | |||||||||||||||||||
| 5 | Practices Act is amended by adding Section 2QQQ as follows:

| 6 | (815 ILCS 505/2QQQ new) | |||||||||||||||||||
| 7 | Sec. 2QQQ. Credit card surcharges prohibited. | |||||||||||||||||||
| 8 | (a) No person in any sales transaction may impose a | |||||||||||||||||||
| 9 | surcharge upon a consumer who elects to pay by use of a credit | |||||||||||||||||||
| 10 | card instead of making payment by cash, check, or similar means | |||||||||||||||||||
| 11 | of payment. | |||||||||||||||||||
| 12 | (b) A violation of this Section constitutes an unlawful | |||||||||||||||||||
| 13 | practice within the meaning of this Act.

| 14 | Section 99. Effective date. This Act takes effect upon | |||||||||||||||||||
| 15 | becoming law.
