AMENDMENT TO HOUSE BILL 821
AMENDMENT NO. ______. Amend House Bill 821 by replacing
everything after the enacting clause with the following:
"Section 5. The Code of Criminal Procedure of 1963 is
amended by adding Section 122-6.1 as follows:
(725 ILCS 5/122-6.1 new)
Sec. 122-6.1. Innocent petitioner; certificate of
innocence and expungement. If at the conclusion of a proceeding
under this Article the court finds that the petitioner
established his or her innocence by clear and convincing
evidence, the court shall:
(1) order that a certificate of innocence be issued to the
petitioner for all offenses for which a finding of innocence
was made; and
(2) enter an order of expungement as provided in subsection
(b) of Section 5-5-4 of the Unified Code of Corrections.".
