Bill Title: Creates the Private Electronic Communications Protection Act. Prohibits the State or units of local government, notwithstanding any other provision of law or rule to the contrary, from using a person's private electronic communication or data held by a third-party computer service or communications common carrier in any judicial, criminal, civil, or administrative proceeding, unless the person's private electronic communication or data was obtained by a court issued search warrant, order authorizing use of an eavesdropping device, or order authorizing interception of private communications. Provides an exception if consented to by the sender and recipient of the private electronic communication or if obtained under a constitutionally authorized exception to the search warrant requirement. Makes any private electronic communication obtained in violation of this requirement inadmissible in any judicial, criminal, civil, or administrative proceeding. Defines terms. Amends the Criminal Code of 2012 and the Code of Criminal Procedure of 1963. Adds private electronic communications and data to the search warrant, eavesdropping, and wiretap provisions. Effective immediately.
