Comments: IL HB5528 | 2021-2022 | 102nd General Assembly

Bill Title: Amends the Unified Code of Corrections. Provides that the form of the judge's statement to the defendant on the amount of time that the defendant shall serve in prison, assuming the defendant receives all of his or her sentence credit, the period of estimated actual custody is so many years and months, less up to 180 days additional earned sentence credit for sentences of incarceration that are less than 5 years and up to 365 days additional earned sentence credit for sentences of incarceration that are 5 years or more. Clarifies that, if the defendant, because of his or her own misconduct or failure to comply with the institutional regulations, does not receive those credits, the actual time served in prison will be longer. The defendant may also receive an additional one (rather than one-half) day sentence credit for each day of participation in vocational, industry, substance abuse, and educational programs as provided for by Illinois statute and one-half day sentence credit for each day of participation in self-improvement programs, volunteer work, or work assignments.
