| 1 | AMENDMENT TO SENATE BILL 2140
| ||||||
| 2 | AMENDMENT NO. ______. Amend Senate Bill 2140 by replacing | ||||||
| 3 | everything after the enacting clause with the following:
| ||||||
| 4 | "Section 5. The Kyoto Protocol Act of 1998 is amended by | ||||||
| 5 | changing Section 15 as follows:
| ||||||
| 6 | (415 ILCS 140/15)
| ||||||
| 7 | Sec. 15. Restrictions on State rules related to greenhouse | ||||||
| 8 | gas emissions.
| ||||||
| 9 | (a) Effective immediately, the
the Environmental | ||||||
| 10 | Protection Agency and the
Pollution Control Board shall not | ||||||
| 11 | propose or adopt any new rule
for the intended purpose of | ||||||
| 12 | addressing the adverse effects of climate change
which in whole | ||||||
| 13 | or in
part reduces emissions of greenhouse gases, as those | ||||||
| 14 | gases are defined by the
Kyoto Protocol, from the residential, | ||||||
| 15 | commercial, industrial, electric utility,
or transportation | ||||||
| 16 | sectors.
In the absence of an Act of the General Assembly | ||||||
| |||||||
| |||||||
| 1 | approving such rules, the
Director of the Environmental | ||||||
| 2 | Protection Agency shall not submit to the U.S.
Environmental | ||||||
| 3 | Protection Agency or to any other agency of the federal
| ||||||
| 4 | government any legally enforceable commitments related to the | ||||||
| 5 | reduction of
greenhouse gases, as those gases are defined by | ||||||
| 6 | the Kyoto Protocol. | ||||||
| 7 | (b) Nothing in this Section shall be construed to (i) limit | ||||||
| 8 | or impede the
authority of the Illinois Environmental | ||||||
| 9 | Protection Agency and Illinois
Pollution Control Board to | ||||||
| 10 | propose, adopt, or enforce rules and laws which
implement the | ||||||
| 11 | federal Clean Air Act or are intended to attain or maintain
| ||||||
| 12 | national ambient air quality standards; or (ii) limit or impede | ||||||
| 13 | State or
private participation in any on-going voluntary | ||||||
| 14 | initiatives to reduce emissions
of greenhouse gases, | ||||||
| 15 | including, but not limited to, the U.S. Environmental
| ||||||
| 16 | Protection Agency's Green Lights
program, the U.S. Department | ||||||
| 17 | of Energy's Climate Challenge program, and similar
State and | ||||||
| 18 | federal initiatives relying on voluntary participation, | ||||||
| 19 | provided,
however, that said rule-making or participation does | ||||||
| 20 | not involve any allocation
or other distribution of greenhouse | ||||||
| 21 | gas emission entitlements pursuant to or
under color of the | ||||||
| 22 | Kyoto Protocol.
