| 1 | AMENDMENT TO SENATE BILL 2011
| ||||||
| 2 | AMENDMENT NO. ______. Amend Senate Bill 2011 on page 12, by | ||||||
| 3 | inserting immediately below line 2 the following: | ||||||
| 4 | "(m)(1) Except as provided in paragraph (2) of this | ||||||
| 5 | subsection (m), when issuing a prescription for an opiate to a | ||||||
| 6 | patient 18 years of age or older for outpatient use for the | ||||||
| 7 | first time, a practitioner may not issue a prescription for | ||||||
| 8 | more than a 7-day supply. A practitioner may not issue an | ||||||
| 9 | opiate prescription to a person under 18 years of age for more | ||||||
| 10 | than a 7-day supply at any time and shall discuss with the | ||||||
| 11 | parent or guardian of the person under 18 years of age the | ||||||
| 12 | risks associated with opiate use and the reasons why the | ||||||
| 13 | prescription is necessary. | ||||||
| 14 | (2) Notwithstanding paragraph (1) of this subsection (m), | ||||||
| 15 | if, in the professional medical judgment of a practitioner, | ||||||
| 16 | more than a 7-day supply of an opiate is required to treat the | ||||||
| 17 | patient's acute medical condition or is necessary for the | ||||||
| 18 | treatment of chronic pain management, pain associated with a | ||||||

| 1 | cancer diagnoses, or for palliative care, then the practitioner | ||||||
| 2 | may issue a prescription for the quantity needed to treat that | ||||||
| 3 | acute medical condition, chronic pain, pain associated with a | ||||||
| 4 | cancer diagnosis, or pain experienced while the patient is in | ||||||
| 5 | palliative care. The condition triggering the prescription of | ||||||
| 6 | an opiate for more than a 7-day supply shall be documented in | ||||||
| 7 | the patient's medical record and the practitioner shall | ||||||
| 8 | indicate that a non-opiate alternative was not appropriate to | ||||||
| 9 | address the medical condition. | ||||||
| 10 | (3) Notwithstanding paragraphs (1) and (2) of this | ||||||
| 11 | subsection (m), this subsection (m) does not apply to | ||||||
| 12 | medications designed for the treatment of substance abuse or | ||||||
| 13 | opioid dependence.".
