| 1 | AMENDMENT TO SENATE BILL 1938
| ||||||
| 2 | AMENDMENT NO. ______. Amend Senate Bill 1938 by replacing | ||||||
| 3 | everything after the enacting clause with the following:
| ||||||
| 4 | "Section 5. (a) The Director of the Department of Natural | ||||||
| 5 | Resources, on behalf of the State of Illinois, is authorized to | ||||||
| 6 | execute and deliver to the City of Wyoming, a municipality | ||||||
| 7 | organized and existing under the laws of the State of Illinois, | ||||||
| 8 | of the County of Stark, State of Illinois, for and in | ||||||
| 9 | consideration of $1.00 paid to the Department, a quitclaim deed | ||||||
| 10 | to the following described real property, to wit:
| ||||||
| 11 | A tract conveyed to the State of Illinois, Department of | ||||||
| 12 | Conservation (now Department of Natural Resources | ||||||
| 13 | (Document Number 53205) described as Lot 1, Block 10; and | ||||||
| 14 | part of Lot 3, Block 9 in Dana's Addition to City of | ||||||
| 15 | Wyoming in Section l, Township 12 North, Range 6 East, of | ||||||
| 16 | the 46 Principal Meridian, Stark County, Illinois.

| |||||||
| 1 | (b) The conveyance of real property shall be made subject | ||||||
| 2 | to: (1) existing public utilities, existing public roads, and | ||||||
| 3 | any and all reservations, easements, encumbrances, covenants, | ||||||
| 4 | and restrictions of record; and (2) the express condition that | ||||||
| 5 | if the real property ceases to be used for public purposes, it | ||||||
| 6 | shall revert to the State of Illinois, Department of Natural | ||||||
| 7 | Resources.
| ||||||
| 8 | Section 10. (a) The Director of the Department of Natural | ||||||
| 9 | Resources, on behalf of the State of Illinois, is authorized to | ||||||
| 10 | execute and deliver to the City of Ottawa, a municipality | ||||||
| 11 | organized and existing under the laws of the State of Illinois, | ||||||
| 12 | of the County of LaSalle, State of Illinois, for and in | ||||||
| 13 | consideration of $1.00 paid to the Department, a quitclaim deed | ||||||
| 14 | to the following described real property, to wit:
| ||||||
| 15 | That part of the Fox River Feeder Canal right of way South | ||||||
| 16 | of Union Addition to Ottawa, North of Railroad Addition to | ||||||
| 17 | Ottawa, East of the East right of way line of Columbus | ||||||
| 18 | Street (State Route 23) and West of the East right of way | ||||||
| 19 | line of Paul Street extended North to the South line of | ||||||
| 20 | Union Addition to Ottawa, all in the Southeast Quarter of | ||||||
| 21 | Section 2, Township 33 North, Range 3 East of the Third | ||||||
| 22 | Principal Meridian, City of Ottawa, LaSalle County, | ||||||
| 23 | Illinois, more particularly described as follows:

| 12 | of equal or greater value in St. Clair County, Illinois, | ||||||
| 13 | hereinafter referred to as Parcel 2, the Parcels being | ||||||
| 14 | described as follows:

| 16 | Legal Description: Part of a tract described in Warranty | ||||||
| 17 | Deed from the East St. Louis Park District to the People of | ||||||
| 18 | the State of Illinois, date May 1, 1946 and recorded May 3, | ||||||

| 6 | (d) This transaction will be to the mutual advantages of | ||||||
| 7 | both parties. Each party shall be responsible for any and all | ||||||
| 8 | title costs associated with their respective properties.

| 9 | Section 20. (a) The Director of the Department of Natural | ||||||
| 10 | Resources, on behalf of the State of Illinois, is authorized to | ||||||
| 11 | exchange certain real property in Pulaski County, Illinois, | ||||||
| 12 | hereinafter referred to in this Section as Parcel 1, for | ||||||
| 13 | certain real property of equal or greater value in Pulaski | ||||||
| 14 | County, Illinois, hereinafter referred to in this Section as | ||||||
| 15 | Parcel 2, the Parcels being described as follows:
| ||||||
| 16 | PARCEL 1:
| ||||||
| 17 | The North 106 feet of the following described tract of land | ||||||
| 18 | conveyed to the People of the State of Illinois, Department | ||||||
| 19 | of Natural Resources, Springfield, IL., by Warranty Deed | ||||||
| 20 | dated June 19, 2009, recorded June 25, 2009, Document No. | ||||||
| 21 | 24582, in Book 257, Page 816, described as follows to-wit:
| ||||||
| 22 | "A tract of land in the Southwest Quarter of the Northwest | ||||||

| 17 | Section or Sections containing the land descriptions of the | ||||||
| 18 | property to be conveyed, and this Section within 60 days after | ||||||
| 19 | its effective date and, upon receipt of the payment required by | ||||||
| 20 | the Section or Sections, if any payment is required, shall | ||||||
| 21 | record the certified document in the Recorder's Office in the | ||||||
| 22 | County in which the land is located.
| ||||||
| 23 | Section 99. Effective date. This Act takes effect upon | ||||||
| 24 | becoming law.".
