1 | AMENDMENT TO SENATE BILL 1595
| ||||||
2 | AMENDMENT NO. ______. Amend Senate Bill 1595 by replacing | ||||||
3 | everything after the enacting clause with the following:
| ||||||
4 | "Section 1. Short title. This Act may be cited as the Music | ||||||
5 | Therapy Advisory Board Act.
| ||||||
6 | Section 5. Definitions. As used in this Act: | ||||||
7 | "Board" means the Music Therapy Advisory Board. | ||||||
8 | "Music therapist" means a person who is certified by the | ||||||
9 | Certification Board for Music Therapists. | ||||||
10 | "Music therapy" means the clinical and evidence-based use | ||||||
11 | of music interventions to accomplish individualized goals for | ||||||
12 | people of all ages and ability levels within a therapeutic | ||||||
13 | relationship by a credentialed professional who has completed | ||||||
14 | an approved music therapy program. The music therapy | ||||||
15 | interventions may include music improvisation, receptive music | ||||||
16 | listening, song writing, lyric discussion, music and imagery, |

1 | singing, music performance, learning through music, music | ||||||
2 | combined with other arts, music-assisted relaxation, | ||||||
3 | music-based patient education, electronic music technology, | ||||||
4 | adapted music intervention, and movement to music. The term | ||||||
5 | "music therapy" does not include the diagnosis or assessment of | ||||||
6 | any physical, mental, or communication disorder. | ||||||
7 | "Department" means the Department of Financial and | ||||||
8 | Professional Regulation. | ||||||
9 | "Secretary" means the Secretary of Financial and | ||||||
10 | Professional Regulation or his or her designee.

11 | Section 10. Advisory board. | ||||||
12 | (a) There is created the Music Therapy Advisory Board | ||||||
13 | within the Department. The Board shall consist of 10 members | ||||||
14 | appointed by the Secretary. The Secretary shall make the | ||||||
15 | appointments to the Board within 90 days after the effective | ||||||
16 | date of this Act. The members of the Board shall represent | ||||||
17 | different racial and ethnic backgrounds and have the | ||||||
18 | qualifications as follows: | ||||||
19 | (1) three members who currently serve as music | ||||||
20 | therapists in Cook County; | ||||||
21 | (2) one member who currently serves as a music | ||||||
22 | therapist in DuPage, Kane, Lake, or Will County; | ||||||
23 | (3) one member who currently serves as a music | ||||||
24 | therapist in Bond, Calhoun, Clinton, Jersey, Macoupin, | ||||||
25 | Madison, Monroe, Montgomery, Randolph, St. Clair, or |

1 | Washington County; | ||||||
2 | (4) one member who currently serves as a music | ||||||
3 | therapist in any other county in the State; | ||||||
4 | (5) one member who is a licensed psychologist in | ||||||
5 | Illinois; | ||||||
6 | (6) one member who is a licensed social worker or | ||||||
7 | counselor; | ||||||
8 | (7) one member who currently employs music therapists; | ||||||
9 | and | ||||||
10 | (8) one representative of a community college, | ||||||
11 | university, or educational institution that provides | ||||||
12 | training to music therapists.

13 | (b) In addition, the following persons may each appoint an | ||||||
14 | ex officio, non-voting member of the Board: the Executive | ||||||
15 | Director of the Illinois Community College Board, the Director | ||||||
16 | of Children and Family Services, the Director of Aging, the | ||||||
17 | Director of Public Health, the Director of Employment Security, | ||||||
18 | the Director of Commerce and Economic Opportunity, the | ||||||
19 | Secretary of Financial and Professional Regulation, the | ||||||
20 | Director of Healthcare and Family Services, and the Secretary | ||||||
21 | of Human Services. | ||||||
22 | (c) The voting members of the Board shall select a | ||||||
23 | chairperson from the voting members of the Board. The Board | ||||||
24 | shall consult with additional experts as needed. Five members | ||||||
25 | constitute a quorum. The Board shall hold its first meeting | ||||||
26 | within 30 days after the appointment of members by the |

1 | Secretary. Members of the Board shall serve without | ||||||
2 | compensation. The Department shall provide administrative and | ||||||
3 | staff support to the Board. The meetings of the Board are | ||||||
4 | subject to the provisions of the Open Meetings Act. | ||||||
5 | (d) The Board shall consider the core competencies of a | ||||||
6 | music therapist, including skills and areas of knowledge that | ||||||
7 | are essential to bringing about music therapy services to | ||||||
8 | communities by qualified individuals. As relating to music | ||||||
9 | therapy services, the core competencies for effective music | ||||||
10 | therapists may include, but are not limited to:
| ||||||
11 | (1) materials to educate the public concerning music | ||||||
12 | therapist licensure; | ||||||
13 | (2) the benefits of music therapy; | ||||||
14 | (3) the utilization of music therapy by individuals and | ||||||
15 | in facilities or institutional settings; | ||||||
16 | (4) culturally competent communication and care; | ||||||
17 | (5) music therapy for behavior change; | ||||||
18 | (6) support from the American Music Therapy | ||||||
19 | Association or any successor organization and the | ||||||
20 | Certification Board for Music Therapists; | ||||||
21 | (7) clinical training; and | ||||||
22 | (8) education and continuing education requirements.

23 | Section 15. Report. | ||||||
24 | (a) The Board shall develop a report with its | ||||||
25 | recommendations regarding the certification process for music |

| |||||||
1 | therapists. The report shall be completed no later than 12 | ||||||
2 | months after the first meeting of the Board. The report shall | ||||||
3 | be submitted to all members and ex officio members of the | ||||||
4 | Board, the Governor, the President of the Senate, the Minority | ||||||
5 | Leader of the Senate, the Speaker of the House of | ||||||
6 | Representatives, and the Minority Leader of the House of | ||||||
7 | Representatives. The Department shall publish the report on its | ||||||
8 | Internet website. | ||||||
9 | (b) The report shall at a minimum include the following: | ||||||
10 | (1) a summary of research regarding the best practices, | ||||||
11 | curriculum, and training programs for designing a | ||||||
12 | certification program in this State for music therapists, | ||||||
13 | including a consideration of a multi-tiered education or | ||||||
14 | training system, statewide certification, | ||||||
15 | non-certification degree-based levels of certification, | ||||||
16 | support from the American Music Therapy Association and | ||||||
17 | Certification Board for Music Therapists, and the | ||||||
18 | requirements for experience-based certification; | ||||||
19 | (2) recommendations regarding certification and | ||||||
20 | renewal process for music therapists and a system of | ||||||
21 | approval and accreditation for curriculum and training; | ||||||
22 | (3) recommendations for a proposed curriculum for | ||||||
23 | music therapists that ensures the content, methodology, | ||||||
24 | development, and delivery of any proposed program is | ||||||
25 | appropriately based on cultural, geographic, and other | ||||||
26 | specialty needs and also reflects relevant |

1 | responsibilities for music therapists; and | ||||||
2 | (4) recommendations for best practices for | ||||||
3 | reimbursement options and pathways through which secure | ||||||
4 | funding for music therapists may be obtained. | ||||||
5 | (c) The Board shall advise the Department, the Governor, | ||||||
6 | and the General Assembly on all matters that impact the | ||||||
7 | effective work of music therapists.".
