| 1 | AMENDMENT TO SENATE BILL 1562
| ||||||
| 2 | AMENDMENT NO. ______. Amend Senate Bill 1562, AS AMENDED, | ||||||
| 3 | by replacing everything after the enacting clause with the | ||||||
| 4 | following:
| ||||||
| 5 | "Section 5. The Abandoned Housing Rehabilitation Act is | ||||||
| 6 | amended by changing Section 2 as follows:
| ||||||
| 7 | (310 ILCS 50/2) (from Ch. 67 1/2, par. 852)
| ||||||
| 8 | Sec. 2. Definitions. As used in this Act:
| ||||||
| 9 | (a) "Property" means any residential real estate which has | ||||||
| 10 | been continuously unoccupied by
persons legally in possession | ||||||
| 11 | for the preceding 1 year.
| ||||||
| 12 | (b) "Nuisance" means any property which because of its | ||||||
| 13 | physical
condition or use is a public nuisance, or any property
| ||||||
| 14 | which constitutes a blight on the surrounding area, or any | ||||||
| 15 | property which
is not fit for human habitation under the | ||||||
| 16 | applicable fire, building and
housing codes.
"Nuisance" also | ||||||
| |||||||
| |||||||
| 1 | means any property on which any illegal activity involving
| ||||||
| 2 | controlled substances (as defined in the Illinois Controlled | ||||||
| 3 | Substances Act), methamphetamine (as defined in the | ||||||
| 4 | Methamphetamine Control and Community Protection Act), or
| ||||||
| 5 | cannabis (as defined in the Cannabis Control Act) takes place | ||||||
| 6 | or any property
on which any streetgang-related activity (as | ||||||
| 7 | defined in the Illinois Streetgang
Terrorism Omnibus | ||||||
| 8 | Prevention Act) takes place.
| ||||||
| 9 | (c) "Organization" means any Illinois corporation, agency, | ||||||
| 10 | partnership,
association, firm or other entity consisting of 2 | ||||||
| 11 | or more persons organized
and conducted on a not-for-profit | ||||||
| 12 | basis with no personal profit inuring to
anyone as a result of | ||||||
| 13 | its operation which
has among its purposes the improvement of | ||||||
| 14 | housing.
| ||||||
| 15 | (d) "Parties in interest" means any owner or owners of | ||||||
| 16 | record, judgment
creditor,
tax purchaser, the applicable unit | ||||||
| 17 | of local government where the property is located, or other | ||||||
| 18 | party having any legal or equitable title or
interest in the | ||||||
| 19 | property.
| ||||||
| 20 | (e) "Last known address" includes
the address where the | ||||||
| 21 | property
is located, or the address as listed in the tax | ||||||
| 22 | records or as listed
pursuant to any owner's registration
| ||||||
| 23 | ordinance duly adopted by a home rule unit of government.
| ||||||
| 24 | (f) "Low or moderate income housing" means housing for | ||||||
| 25 | persons and families
with low or moderate incomes, provided | ||||||
| 26 | that the income limits for such
persons and families shall be | ||||||
| |||||||
| |||||||
| 1 | the same as those established by rule by the
Illinois Housing | ||||||
| 2 | Development Authority in accordance with
subsection (g) of | ||||||
| 3 | Section 2 of the Illinois Housing Development Act, as
amended.
| ||||||
| 4 | (g) "Rehabilitation" means the process of improving the | ||||||
| 5 | property,
including, but not limited to, ensuring that the | ||||||
| 6 | proposed improvements conform with a local government's | ||||||
| 7 | comprehensive plan or other planning policies and bringing | ||||||
| 8 | property into compliance with
the applicable unit of local | ||||||
| 9 | government's fire, housing, licensing, zoning, and building | ||||||
| 10 | codes.
