| 1 | AMENDMENT TO SENATE BILL 1371
| ||||||
| 2 | AMENDMENT NO. ______. Amend Senate Bill 1371 by replacing | ||||||
| 3 | everything after the enacting clause with the following:
| ||||||
| 4 | "Section 5. The School Code is amended by adding Sections | ||||||
| 5 | 10-20.69 and 34-18.61 as follows:
| ||||||
| 6 | (105 ILCS 5/10-20.69 new) | ||||||
| 7 | Sec. 10-20.69. Door security locking means. | ||||||
| 8 | (a) In this Section, "door security locking means" means a | ||||||
| 9 | door locking means intended for use by a trained school | ||||||
| 10 | district employee in a school building for the purpose of | ||||||
| 11 | preventing ingress through a door of the building. | ||||||
| 12 | (b) A school district may install a door security locking | ||||||
| 13 | means on a door of a school building to prevent unwanted entry | ||||||
| 14 | through the door if all of the following requirements are met: | ||||||
| 15 | (1) The door security locking means can be engaged | ||||||
| 16 | without opening the door. | ||||||

| 1 | (2) The unlocking and unlatching of the door security | ||||||
| 2 | locking means from the occupied side of the door can be | ||||||
| 3 | accomplished without the use of a key or tool. | ||||||
| 4 | (3) The door security locking means complies with all | ||||||
| 5 | applicable State and federal accessibility requirements. | ||||||
| 6 | (4) Locks, if remotely engaged, can be unlocked from | ||||||
| 7 | the occupied side. | ||||||
| 8 | (5) The door security locking means is capable of being | ||||||
| 9 | disengaged from the outside by school district employees, | ||||||
| 10 | and school district employees may use a key or other | ||||||
| 11 | credentials to unlock the door from the outside. | ||||||
| 12 | (6) The door security locking means does not modify the | ||||||
| 13 | door-closing hardware, panic hardware, or fire exit | ||||||
| 14 | hardware. | ||||||
| 15 | (7) Any bolts, stops, brackets, or pins employed by the | ||||||
| 16 | door security locking means do not affect the fire rating | ||||||
| 17 | of a fire door assembly. | ||||||
| 18 | (8) School district employees are trained in the | ||||||
| 19 | engagement and release of the door security locking means, | ||||||
| 20 | from within and outside the room, as part of the emergency | ||||||
| 21 | response plan. | ||||||
| 22 | (9) For doors installed before July 1, 2019 only, the | ||||||
| 23 | unlocking and unlatching of a door security locking means | ||||||
| 24 | requires no more than 2 releasing operations. For doors | ||||||
| 25 | installed on or after July 1, 2019, the unlocking and | ||||||
| 26 | unlatching of a door security locking means requires no | ||||||
| |||||||
| |||||||
| 1 | more than one releasing operation. If doors installed | ||||||
| 2 | before July 1, 2019 are replaced on or after July 1, 2019, | ||||||
| 3 | the unlocking and unlatching of a door security locking | ||||||
| 4 | means on the replacement door requires no more than one | ||||||
| 5 | releasing operation. | ||||||
| 6 | (10) The door security locking means is no more than 48 | ||||||
| 7 | inches above the finished floor. | ||||||
| 8 | (11) The door security locking means otherwise | ||||||
| 9 | complies with the school building code prepared by the | ||||||
| 10 | State Board of Education under Section 2-3.12. | ||||||
| 11 | A school district may install a door security locking means | ||||||
| 12 | that does not comply with paragraph (3) or (10) of this | ||||||
| 13 | subsection if (i) the school district meets all other | ||||||
| 14 | requirements under this subsection and (ii) prior to its | ||||||
| 15 | installation, local law enforcement officials, the local fire | ||||||
| 16 | department, and the school board agree, in writing, to the | ||||||
| 17 | installation and use of the door security locking means. The | ||||||
| 18 | school district must keep the agreement on file and must, upon | ||||||
| 19 | request, provide the agreement to its regional office of | ||||||
| 20 | education. The agreement must be included in the school | ||||||
| 21 | district's filed school safety plan under the School Safety | ||||||
| 22 | Drill Act. | ||||||
| 23 | (c) A school district must include the location of any door | ||||||
| 24 | security locking means and must address the use of the locking | ||||||
| 25 | and unlocking means from within and outside the room in its | ||||||
| 26 | filed school safety plan under the School Safety Drill Act. | ||||||

| |||||||
| 1 | Local law enforcement officials and the local fire department | ||||||
| 2 | must be notified of the location of any door security locking | ||||||
| 3 | means and how to disengage it. Any specific tool needed to | ||||||
| 4 | disengage the door security locking means from the outside of | ||||||
| 5 | the room must, upon request, be made available to local law | ||||||
| 6 | enforcement officials and the local fire department. | ||||||
| 7 | (d) A door security locking means may be used only (i) by a | ||||||
| 8 | school district employee trained under subsection (e), (ii) | ||||||
| 9 | during an emergency that threatens the health and safety of | ||||||
| 10 | students and employees or during an active shooter drill, and | ||||||
| 11 | (iii) when local law enforcement officials and the local fire | ||||||
| 12 | department have been notified of its installation prior to its | ||||||
| 13 | use. The door security locking means must be engaged for a | ||||||
| 14 | finite period of time in accordance with the school district's | ||||||
| 15 | school safety plan adopted under the School Safety Drill Act. | ||||||
| 16 | (e) A school district that has installed a door security | ||||||
| 17 | locking means shall conduct an in-service training program for | ||||||
| 18 | school district employees on the proper use of the door | ||||||
| 19 | security locking means. The school district shall keep a file | ||||||
| 20 | verifying the employees who have completed the program and | ||||||
| 21 | must, upon request, provide the file to its regional office of | ||||||
| 22 | education and the local fire department and local law | ||||||
| 23 | enforcement agency. | ||||||
| 24 | (f) A door security locking means that requires 2 releasing | ||||||
| 25 | operations must be discontinued from use when the door is | ||||||
| 26 | replaced or is a part of new construction. Replacement and new | ||||||
| |||||||
| |||||||
| 1 | construction door hardware must include mortise locks, | ||||||
| 2 | compliant with the applicable building code, and must be | ||||||
| 3 | lockable from the occupied side without opening the door. | ||||||
| 4 | However, mortise locks are not required if panic hardware or | ||||||
| 5 | fire exit hardware is required.
