| 1 | AMENDMENT TO SENATE BILL 513
| ||||||
| 2 | AMENDMENT NO. ______. Amend Senate Bill 513 by replacing | ||||||
| 3 | everything after the enacting clause with the following:
| ||||||
| 4 | "Section 5. The Illinois Vehicle Code is amended by | ||||||
| 5 | changing Section 1-146 and by adding Sections 1-194.5 and | ||||||
| 6 | 11-1518 as follows:
| ||||||
| 7 | (625 ILCS 5/1-146) (from Ch. 95 1/2, par. 1-146)
| ||||||
| 8 | Sec. 1-146. Motor vehicle. Every vehicle which is | ||||||
| 9 | self-propelled and
every vehicle which is
propelled by electric | ||||||
| 10 | power obtained from overhead trolley wires, but not
operated | ||||||
| 11 | upon rails, except for vehicles moved solely by human power,
| ||||||
| 12 | motorized wheelchairs, low-speed electric bicycles, stand-up | ||||||
| 13 | foot scooters, and low-speed gas bicycles. For this Act, motor | ||||||
| 14 | vehicles are divided into two
divisions:
| ||||||
| 15 | First Division: Those motor vehicles which are designed for | ||||||
| 16 | the carrying
of not more than 10 persons.

| 1 | Second Division: Those motor vehicles which are designed | ||||||
| 2 | for carrying
more than 10 persons, those motor vehicles | ||||||
| 3 | designed or used for living
quarters, those
motor vehicles | ||||||
| 4 | which are designed for pulling or carrying freight, cargo
or | ||||||
| 5 | implements of husbandry, and those motor vehicles of
the First | ||||||
| 6 | Division remodelled for use and used
as motor vehicles of the | ||||||
| 7 | Second Division.

| 9 | (625 ILCS 5/1-194.5 new) | ||||||
| 10 | Sec. 1-194.5. Stand-up foot scooter. A device with no more | ||||||
| 11 | than 2 10-inch or smaller diameter wheels that has handlebars, | ||||||
| 12 | is designed to be stood upon by the operator, and is powered by | ||||||
| 13 | an electric motor that is capable of propelling the device with | ||||||
| 14 | or without human propulsion at a speed no more than 15 miles | ||||||
| 15 | per hour on a paved level surface.

| 16 | (625 ILCS 5/11-1518 new) | ||||||
| 17 | Sec. 11-1518. Stand-up foot scooters. | ||||||
| 18 | (a) Except as otherwise provided in this Section, the | ||||||
| 19 | provisions of this Chapter that apply to bicycles also apply to | ||||||
| 20 | stand-up foot scooters. | ||||||
| 21 | (b) A person may operate a stand-up foot scooter upon any | ||||||
| 22 | highway, street, or roadway authorized for use by bicycles, | ||||||
| 23 | including, but not limited to, bicycle lanes or bicycle paths. | ||||||
| 24 | An operator does not require a driver's license or instruction | ||||||

| |||||||
| 1 | permit to operate a stand-up foot scooter. | ||||||
| 2 | (c) A person may operate a stand-up foot scooter upon any | ||||||
| 3 | bicycle lane or bicycle path unless the municipality, county, | ||||||
| 4 | or local authority with jurisdiction prohibits the use of | ||||||
| 5 | stand-up foot scooters on that bicycle lane or bicycle path. A | ||||||
| 6 | stand-up foot scooter may be parked in the same manner and at | ||||||
| 7 | the same locations as a bicycle may be parked. | ||||||
| 8 | (d) A person may operate a stand-up foot scooter only if he | ||||||
| 9 | or she is 16 years of age or older.".
