| 1 | AMENDMENT TO SENATE BILL 421
| ||||||
| 2 | AMENDMENT NO. ______. Amend Senate Bill 421 by replacing | ||||||
| 3 | everything after the enacting clause with the following:
| ||||||
| 4 | "Section 5. The Airport Authorities Act is amended by | ||||||
| 5 | changing Section 8.14 and by adding Section 8.12a as follows:
| ||||||
| 6 | (70 ILCS 5/8.12a new) | ||||||
| 7 | Sec. 8.12a. Drones. To regulate the movement of drones, as | ||||||
| 8 | defined in Section 5 of the Freedom from Drone Surveillance | ||||||
| 9 | Act, upon the surface of any public airport or in the air above | ||||||
| 10 | the incorporated territory of the authority.
| ||||||

| 12 | Sec. 8.14.
Rules and regulations adopted under and in | ||||||
| 13 | pursuance of the powers
granted by Sections 8.10, 8.11, and | ||||||
| 14 | 8.12, and 8.12a must be contained in an ordinance
which shall | ||||||
| 15 | be placed on file in the office of the Authority in typewritten
| ||||||
| |||||||
| |||||||
| 1 | or printed form for public inspection not less than 15 days | ||||||
| 2 | before
adoption. Such ordinance may prescribe such fines as the | ||||||
| 3 | Board of
Commissioners deems appropriate of not less than $1 | ||||||
| 4 | nor more than $200, or not less than $100 nor more than $1,000 | ||||||
| 5 | for violations concerning the movement of drones, upon
| ||||||
| 6 | conviction for each offense, and may provide that, in case of | ||||||
| 7 | continuing
violation of any such rule or regulation, each | ||||||
| 8 | calendar day that such
violation continues constitutes a | ||||||
| 9 | separate offense.
| ||||||
| 10 | Notice of the filing of and public hearing upon any | ||||||
| 11 | ordinance
prescribing fines or penalties and of the date and | ||||||
| 12 | time for its being
publicly heard shall be published one time | ||||||
| 13 | in a newspaper generally
circulated within the Authority not | ||||||
| 14 | more than 30 nor less than 15 days
prior to the date of such | ||||||
| 15 | hearing. Such ordinance may be amended at the
public hearing | ||||||
| 16 | and may be later amended where no new rule or regulation is
| ||||||
| 17 | adopted or existing fine or penalty modified, without | ||||||
| 18 | pre-filing or
publication of notice prior to the adoption of | ||||||
| 19 | the amendatory ordinance.
After adoption, typewritten or | ||||||
| 20 | printed copies of each ordinance of an
authority which | ||||||
| 21 | prescribes fines or penalties shall be made available at
the | ||||||
| 22 | office of the authority for distribution upon request.
| ||||||
| 23 | All fines, when collected, for violations of any such | ||||||
| 24 | ordinance of an
authority shall be paid into its treasury.
| ||||||
