| 1 | AMENDMENT TO HOUSE BILL 3702
| ||||||
| 2 | AMENDMENT NO. ______. Amend House Bill 3702 by replacing | ||||||
| 3 | everything after the enacting clause with the following:
| ||||||
| 4 | "Section 5. The Counties Code is amended by changing | ||||||
| 5 | Section 5-15003 as follows:
| ||||||
| 6 | (55 ILCS 5/5-15003) (from Ch. 34, par. 5-15003)
| ||||||
| 7 | Sec. 5-15003. Department of public works. The county board | ||||||
| 8 | may establish a department of public works with
authority to | ||||||
| 9 | exercise complete supervision in such county over any of the
| ||||||
| 10 | projects authorized by this Division in either of the methods
| ||||||
| 11 | designated hereafter.
| ||||||
| 12 | A. The county board may employ a superintendent of public | ||||||
| 13 | works and such
other employees for the administration of the | ||||||
| 14 | department as may be
necessary. The superintendent shall be a | ||||||
| 15 | registered professional engineer, hold a degree in engineering | ||||||
| 16 | from an accredited institution of higher learning, or have at | ||||||
| |||||||
| |||||||
| 1 | least 10 years of professional, management-level experience in | ||||||
| 2 | either a municipal or county public works department. The | ||||||
| 3 | superintendent
and shall have complete authority to supervise | ||||||
| 4 | and manage the department; or
| ||||||
| 5 | B. Each county public works department shall be managed by | ||||||
| 6 | a board of
public works, consisting of 5 members appointed by | ||||||
| 7 | the President and
Chairman of the county board, with the | ||||||
| 8 | approval of the county board, for a
3 year term, except that of | ||||||
| 9 | the first appointees, 2 shall serve for one
year, 2 for 2 | ||||||
| 10 | years, and one for 3 years. The term of office of original
| ||||||
| 11 | appointees shall be regarded as beginning on July 1, following | ||||||
| 12 | their
appointment, and the term of all members shall continue | ||||||
| 13 | until their
successors are appointed. At least 2 members must | ||||||
| 14 | be elected officials of
municipalities within the county whose | ||||||
| 15 | terms of office within the
municipalities will not expire | ||||||
| 16 | prior to the termination of appointment
hereunder, one member | ||||||
| 17 | must be a member of the county board whose term of
office will | ||||||
| 18 | not expire prior to the termination of appointment hereunder,
| ||||||
| 19 | one member must be a trustee of a Sanitary District within the | ||||||
| 20 | county whose
term of office will not expire prior to the | ||||||
| 21 | termination of appointment
hereunder, and one member must be | ||||||
| 22 | chosen to represent the Conservation and
Public Health | ||||||
| 23 | interests. The members of the board shall receive
compensation | ||||||
| 24 | as provided by the county board. The board of public works may
| ||||||
| 25 | employ a superintendent of public works and any other | ||||||
| 26 | employees for the
administration of the department as may be | ||||||
| |||||||
| |||||||
| 1 | necessary. The superintendent
must be a registered | ||||||
| 2 | professional engineer, hold a degree in engineering from an | ||||||
| 3 | accredited institution of higher learning, or have at least 10 | ||||||
| 4 | years of professional, management-level experience in either a | ||||||
| 5 | municipal or county public works department. Any county may | ||||||
| 6 | advance general
funds for necessary studies or engineering for | ||||||
| 7 | a project to be financed by
revenue bonds and be reimbursed by | ||||||
| 8 | the proceeds of such bonds. Any county
may purchase such bonds | ||||||
| 9 | with funds derived solely from the County Retailers
Occupation | ||||||
| 10 | Tax.
| ||||||

| 12 | Section 99. Effective date. This Act takes effect upon | ||||||
| 13 | becoming law.".
