| 1 | AMENDMENT TO HOUSE BILL 3484

| 2 | AMENDMENT NO. ______. Amend House Bill 3484 by replacing | ||||||
| 3 | everything after the enacting clause with the following:

| 4 | "Section 5. The Department of Public Health Powers and | ||||||
| 5 | Duties Law of the
Civil Administrative Code of Illinois is | ||||||
| 6 | amended by adding Section 2310-678 as follows:
| ||||||
| 7 | (20 ILCS 2310/2310-678 new) | ||||||
| 8 | Sec. 2310-678. Information provided prior to biochemical | ||||||
| 9 | testing of pregnant women or infants for controlled substances. | ||||||
| 10 | The Department shall establish guidelines for health care | ||||||
| 11 | providers, health care professionals, and health care | ||||||
| 12 | facilities requiring that, at a minimum, prior to providing a | ||||||
| 13 | biochemical test for controlled substances to a pregnant | ||||||
| 14 | patient or an infant, and to the extent permitted by law, a | ||||||
| 15 | health care provider, health care professional, or health care | ||||||
| 16 | facility shall provide information to the patient or the | ||||||
| |||||||
| |||||||
| 1 | patient's personal representative that shall include: a | ||||||
| 2 | reasonable explanation of the biochemical test; the test's | ||||||
| 3 | purpose, potential uses, and limitations; the meaning of the | ||||||
| 4 | test's results; the voluntary nature of the test; the | ||||||
| 5 | availability of a qualified person to answer questions; the | ||||||
| 6 | right to withdraw consent to the testing process at any time; | ||||||
| 7 | and the right to confidential treatment of information | ||||||
| 8 | identifying the subject and the results of the test. The | ||||||
| 9 | guidelines shall allow the information to be provided in | ||||||
| 10 | writing, verbally, or by video, electronic, or other means and | ||||||
| 11 | as designated by the supervising health care provider, | ||||||
| 12 | supervising health care professional, or the health care | ||||||
| 13 | facility.".
