AMENDMENT TO HOUSE BILL 3190
AMENDMENT NO. ______. Amend House Bill 3190 by replacing
everything after the enacting clause with the following:
"Section 5. The Environmental Protection Act is amended by
adding Section 9.18 as follows:
(415 ILCS 5/9.18 new)
Sec. 9.18. Perfluoroalkyl and polyfluoroalkyl substances.
(a) In this Section:
"Incineration" includes, but is not limited to, burning,
combustion, pyrolysis, gasification, thermal oxidation
(including flameless and regenerative), acid recovery furnace
or oxidizer, ore roaster, cement kiln, lightweight aggregate
kiln, industrial furnace, boiler, and process heater.
"Perfluoroalkyl and polyfluoroalkyl substances" means a
class of fluorinated organic chemicals containing at least one
fully fluorinated carbon atom.

(b) The disposal by incineration of aqueous film-forming
foam that contains perfluoroalkyl and polyfluoroalkyl
substances is prohibited in an area of environmental justice
concern.
(c) The Agency may adopt rules it deems necessary to carry
out the provisions of this Section.
Section 99. Effective date. This Act takes effect upon
becoming law.".
