| 1 | AMENDMENT TO HOUSE BILL 2427

| 2 | AMENDMENT NO. ______. Amend House Bill 2427 by replacing | ||||||
| 3 | everything after the enacting clause with the following:
| ||||||
| 4 | "Section 5. The Township Code is amended by changing | ||||||
| 5 | Sections 210-7 and 210-10 as follows:
| ||||||
| 6 | (60 ILCS 1/210-7) | ||||||
| 7 | Sec. 210-7. Disposal of brush and leaves. Notwithstanding | ||||||
| 8 | any provision of this Article to the contrary, the corporate | ||||||
| 9 | authorities of a township may, by ordinance, provide for the | ||||||
| 10 | collection, transport, and disposal, and recycling of brush, | ||||||
| 11 | wood chips, and leaves within the unincorporated areas of the | ||||||
| 12 | township without referendum approval. The corporate | ||||||
| 13 | authorities of the township may use funds authorized under | ||||||
| 14 | Section 30-117 to provide for the collection, transport, and | ||||||
| 15 | disposal of brush and leaves.

| ||||||
| 2 | Sec. 210-10. Definitions. As used in this Article, unless | ||||||
| 3 | the context
clearly requires otherwise:
| ||||||
| 4 | "Ashes" means residue from fires used for cooking and for | ||||||
| 5 | heating
buildings.
| ||||||
| 6 | "Garbage" means wastes resulting from the handling, | ||||||
| 7 | preparation, cooking,
and consumption of food and wastes from | ||||||
| 8 | the handling, storage, and sale of
produce.
| ||||||
| 9 | "Recycling" means the transfer of brush, wood chips, or | ||||||
| 10 | leaves by employees of the township to a facility or place that | ||||||
| 11 | will utilize the product without charge. | ||||||
| 12 | "Refuse" means (i) combustible trash, including but not | ||||||
| 13 | limited to paper,
cartons, boxes, barrels, wood, excelsior, | ||||||
| 14 | tree branches, yard trimmings,
wood furniture, and bedding; | ||||||
| 15 | (ii) noncombustible trash, including but not
limited to metals, | ||||||
| 16 | tin cans, metal furniture, dirt, small quantities of rock
and | ||||||
| 17 | pieces of concrete, glass, crockery, and other mineral waste; | ||||||
| 18 | and
(iii) street rubbish, including but not limited to street | ||||||
| 19 | sweepings, dirt,
leaves, catch-basin dirt, and contents of | ||||||
| 20 | litter receptacles. "Refuse" does not
mean earth and wastes | ||||||
| 21 | from building operations, nor does it include solid
wastes | ||||||
| 22 | resulting from industrial processes and manufacturing | ||||||
| 23 | operations such as
food processing wastes, boiler-house | ||||||
| 24 | cinders, lumber, scraps, and shavings.

| 1 | Section 99. Effective date. This Act takes effect upon | ||||||
| 2 | becoming law.".
