AMENDMENT TO HOUSE BILL 531
AMENDMENT NO. ______. Amend House Bill 531 on page 1, line
1, by inserting after "law" the following:
", which may be referred to as the Daniel Capuano Memorial
Act"; and
on page 2, by inserting immediately below line 1 the following:
"(a-5) This Section does not apply:
(1) when the owner or manager of the commercial real
estate within 14 days after receiving notice of the
building code violation begins to have the commercial real
estate repaired to comply with the building code and within
that 14-day period posts signs warning of the danger to the
public from the condition of the commercial real estate; or
(2) if the commercial real estate is vacant and the
owner or manager places conspicuous signs on every entrance
to the commercial real estate indicating that the
commercial real estate is abandoned and unsafe to a first

responder. It is a defense to a violation of this Section
that the signs were destroyed or stolen and that the owner
or manager placed the signs as required by this paragraph
(2) within the past 30 days.".
