AMENDMENT TO HOUSE BILL 142
2 AMENDMENT NO. ______. Amend House Bill 142 by replacing
3everything after the enacting clause with the following:
4 "Section 5. The Illinois Insurance Code is amended by
5adding Section 155.47 as follows:
6 (215 ILCS 5/155.47 new)
7 Sec. 155.47. First-party claimant reimbursement study.
8 (a) Since first-party claimants occasionally have property
9and casualty claims denied in whole or in part and
10subsequently obtain a payment in excess of the initial offer
11of the insurer, the Department shall perform a study of
12whether the claimants shall be entitled to reimbursement of
13their reasonable costs incurred to substantiate the claim. The
14study of the Illinois insurance claims process shall be
15submitted to the General Assembly by January 1, 2022.
16 (b) The Department study shall compare median payments on

1new and reopened claims where the insured had representation
2to claims where the insured did not.
3 (c) The Department study shall take a representative
4sample of claims and examine the type of representation for
5the insured, including representation by a public adjuster,
6attorney, or none; the nature of the claim, including whether
7catastrophic or non-catastrophic; the severity of the loss;
8the insured value of the property; the report year; the date
9the policyholder noticed the loss; the dollar value of the
10insurers' initial offer to a policyholder; the last amount
11paid to a policyholder; the payment date; and the city and
12county in which the property was located.
13 Section 99. Effective date. This Act takes effect upon
14becoming law.".
