Section
331.307,
subsection
9,
paragraph
a,
1
subparagraph
(5),
Code
2018,
is
amended
to
read
as
follows:

(5)
Order
that
the
county’s
costs
for
abatement
or

correction
of
the
violation
be
entered
as
a
personal
judgment
4
against
the
defendant
or
assessed
against
the
property
where
5
the
violation
occurred,
or
both
for
collection
in
the
same
6
manner
as
a
property
tax
.

EXPLANATION

The
inclusion
of
this
explanation
does
not
constitute
agreement
with
9
the
explanation’s
substance
by
the
members
of
the
general
assembly.

Under
current
law,
when
a
person
violates
a
county
zoning
11
ordinance
and
the
county
incurs
costs
to
abate
or
correct
the
12
violation,
a
court
may
order
that
the
costs
be
entered
as
a
13
personal
judgment
against
the
defendant,
assessed
against
the
14
property
where
the
violation
occurred,
or
both.
The
bill
15
allows
a
court
to
order
the
costs
be
assessed
against
the
16
property
for
collection
in
the
same
manner
as
a
property
tax.
17
The
bill
does
not
allow
a
court
to
enter
the
costs
as
a
personal
18
judgment
against
the
defendant.
