S.F. _____ Section 1. Section 261E.8, Code 2022, is amended by adding 1 the following new subsection: 2 NEW SUBSECTION . 1A. A school district shall not offer a 3 course pursuant to this section through a community college 4 located outside of the merged area in which the school district 5 is located unless the community college located in the merged 6 area in which the school district is located does not offer a 7 comparable course, as defined in rules adopted by the board of 8 directors of the school district, or unless there is a wait 9 list for the course at the community college located in the 10 merged area in which the school district is located. If a 11 school district determines that the community college located 12 in the merged area in which the school district is located 13 does not offer a comparable course, or if the school district 14 determines that there is a wait list for the course at the 15 community college located in the merged area in which the 16 school district is located, the school district may offer the 17 course pursuant to this section through a community college 18 located outside of the merged area in which the school district 19 is located without the prior approval of the community college 20 located in the merged area in which the school district is 21 located. 22 EXPLANATION 23 The inclusion of this explanation does not constitute agreement with 24 the explanation’s substance by the members of the general assembly. 25 This bill relates to the district-to-community college 26 sharing or concurrent enrollment program and the community 27 colleges through which school districts may offer courses. 28 The bill provides that a school district shall not offer 29 a concurrent enrollment course through a community college 30 located outside of the merged area in which the school district 31 is located unless the community college located in the merged 32 area in which the school district is located does not offer 33 a comparable course, or unless there is a wait list for the 34 course at the community college located in the merged area in 35 -1- LSB 5122XC (5) 89 jda/jh 1/ 2
S.F. _____ which the school district is located. The bill requires the 1 board of directors of the school district to determine what 2 is a comparable course.
