Section 96.1A, Code 2021, is amended by adding 1 the following new subsections: 2 NEW SUBSECTION . 26A. “Integrity data hub” means a 3 centralized, electronic platform, including a successor 4 platform, maintained by the national association of state 5 workforce agencies, or a successor organization, to compare 6 and analyze benefit claims data across states for enhanced 7 detection and prevention of fraud and improper payments. 8 NEW SUBSECTION . 26B. “National directory of new hires” 9 means a database, including a successor database, established 10 by the federal office of child support enforcement pursuant 11 to the federal Personal Responsibility and Work Opportunity 12 Reconciliation Act of 1996, Pub. L. No. 104-193, for the 13 purposes of assisting state child support agencies in locating 14 parents and enforcing child support orders. 15 Sec. 2. NEW SECTION . 96.33 Verification of benefit 16 eligibility. 17 1. The department shall participate in and utilize the 18 integrity data hub to verify the integrity of all claims for 19 benefits in this state. 20 2. On a weekly basis, the department shall check all 21 claims for benefits submitted in the previous week against 22 the most recent list of inmates provided by the department 23 of corrections pursuant to section 904.108 to verify the 24 eligibility for benefits of each claimant. 25 3. On a weekly basis, the department shall check all claims 26 for benefits against the national directory of new hires, as 27 well as any other source of information on newly hired or 28 rehired employees available to the department under state or 29 federal law, to verify the eligibility for benefits of each 30 claimant. 31 4. The department may enter into an agreement pursuant to 32 chapter 28E or execute a memorandum of understanding with other 33 state and federal agencies in order to acquire or gain access 34 to information required to be shared between agencies pursuant 35 -1- LSB 2358XC (1) 89 je/rn 1/ 3

If the department receives information concerning 2 a claimant that indicates a change in the claimant’s 3 circumstances that may affect the claimant’s eligibility 4 for benefits, the department shall review the claimant’s 5 eligibility. 6 Sec. 3. Section 904.108, Code 2021, is amended by adding the 7 following new subsection: 8 NEW SUBSECTION . 7. The director shall provide the 9 department of workforce development access to a list of inmates 10 confined in institutions under the department’s jurisdiction on 11 a weekly basis for purposes of compliance with section 96.33. 12 Sec. 4. EFFECTIVE DATE. This Act takes effect January 1, 13 2022. 14 EXPLANATION 15 The inclusion of this explanation does not constitute agreement with 16 the explanation’s substance by the members of the general assembly. 17 This bill provides for procedures for the department of 18 workforce development to verify eligibility for unemployment 19 benefits. 20 The bill requires the department to participate in and 21 utilize the integrity data hub, as defined in the bill, to 22 verify the integrity of all claims for benefits in Iowa. 23 The bill requires the department to check, on a weekly basis, 24 all claims for benefits submitted in the previous week against 25 the most recent list of inmates provided by the department of 26 corrections pursuant to the bill to verify the eligibility for 27 benefits of each claimant. 28 The bill requires the department to check, on a weekly basis, 29 all claims for benefits against the national directory of new 30 hires, as defined in the bill, as well as any other source 31 of information on newly hired or rehired employees available 32 to the department under state or federal law, to verify the 33 eligibility for benefits of each claimant. 34 The bill authorizes the department to enter into an 35 -2- LSB 2358XC (1) 89 je/rn 2/ 3
