S.F. _____ Section 1. Section 331.321, subsection 1, paragraph l, Code 1 2019, is amended by striking the paragraph. 2 Sec. 2. Section 331.905, subsections 1 and 2, Code 2019, 3 are amended by striking the subsections and inserting in lieu 4 thereof the following: 5 1. There is created in each county a county compensation 6 board that shall be composed of five members who are residents 7 of the county. The members of the county compensation board 8 shall be selected as follows: 9 a. The board of township trustees of each township and the 10 city council of each city located in a county shall by lot 11 select one of the trustees or council members from the board or 12 council, respectively, to serve as a delegate to a temporary 13 compensation board appointing commission, created by resolution 14 of the board of supervisors. The temporary compensation board 15 appointing commission shall meet at a time and place specified 16 in the resolution. 17 b. The members of the temporary compensation board 18 appointing commission shall appoint one of their number to 19 serve on the county compensation board for each vacancy on the 20 county compensation board. 21 2. The members of the county compensation board shall be 22 appointed to four-year, staggered terms of office. The members 23 of the county compensation board shall not be employees of the 24 state or a political subdivision of the state. A term shall be 25 effective on the first of July of the year of appointment and 26 a vacancy shall be filled for the unexpired term in the same 27 manner as the original appointment. 28 Sec. 3. TRANSITION PROVISIONS. A member serving on a 29 county compensation board on June 30, 2019, shall continue 30 serving until the expiration of that member’s term. A member 31 whose term expires on July 1, 2019, shall no longer serve on 32 the county compensation board unless reappointed pursuant to 33 section 331.905. No person shall be appointed if the county 34 compensation board currently has five or more members. A 35 -1- LSB 1846XC (4) 88 js/rn 1/ 2
S.F. _____ county compensation board may continue performing its duties 1 with six members through June 30, 2020, unless the membership 2 of the county compensation board is staggered so that its 3 membership reduces to five members on July 1, 2019, in which 4 case the county compensation board shall continue performing 5 its duties with five members. No county compensation board 6 shall have more than five members on and after July 1, 2020. 7 EXPLANATION 8 The inclusion of this explanation does not constitute agreement with 9 the explanation’s substance by the members of the general assembly. 10 This bill relates to the composition of a county 11 compensation board by requiring that members of the board 12 be appointed by a temporary compensation board appointing 13 commission. Under the bill, each board of township trustees 14 and each city council located in a county are required to 15 appoint one of the members of their respective governing bodies 16 to serve on the commission. The commission is required to 17 appoint one member of the commission to serve on the county 18 compensation board for each vacancy on the county compensation 19 board. 20 Current law also prohibits an officer or employee of the 21 state or a political subdivision of the state from serving on a 22 county compensation board. The bill removes the prohibition 23 on officers. 24 The bill allows a member serving on a county compensation 25 board on June 30, 2019, to continue serving until the 26 expiration of that member’s term. The bill allows a county 27 compensation board to continue performing its duties with six 28 members through June 30, 2020, unless the membership of the 29 county compensation board is staggered so that its membership 30 reduces to five members on July 1, 2019. 31 -2- LSB 1846XC (4) 88 js/rn 2/ 2
