An

amendment
to
the
Iowa
Constitution
was
ratified
on
November
2,

2010,
which
created
a
natural
resources
and
outdoor
recreation
10
trust
fund
(fund)
and
dedicated
a
portion
of
state
revenues
to
11
the
fund
for
the
purposes
of
protecting
and
enhancing
water
12
quality
and
natural
areas
in
the
state
including
parks,
trails,
13
and
fish
and
wildlife
habitat,
and
conserving
agricultural
14
soils
in
the
state
(Article
VII,
section
10).
The
fund
is
15
codified
in
Code
section
461.31.
Pursuant
to
the
amendment,
16
the
amount
credited
to
the
fund
will
be
equal
to
the
amount
17
generated
by
an
increase
in
the
state
sales
tax
rate
occurring

after
the
effective
date
of
the
constitutional
amendment,

wildlife
habitats,
and

amendment

natural
resources
and
outdoor

recreation
trust
fund

within
the
state
treasury.

fund
is
credited
with

equal
to
the
amount
annually

generated
by
a
sales
tax
rate

of

percent.

to
the

bill
strikes

that
exception
and
establishes

conditions
under
which
a
city
with
a
population
that
exceeds

200,000
may
impose
a
franchise
fee
of
up
to
7.5
percent
for
5
fiscal
years
beginning
on
or
after
July
1,
2024.
The
bill

requires
that
franchise
fee
amounts
collected
during
such
7
fiscal
years
in
excess
of
5
percent
of
gross
revenues
generated

from
sales
shall
be
used
solely
for
the
reduction
of
property
9
tax
levies
used
to
support
the
operation
and
maintenance
of
a

municipal
transit
system
or
a
regional
transit
district.

effect
