2021, is amended by striking the paragraph and inserting in
lieu thereof the following:

Sec. 5. Section 124.204, subsection 4, paragraph h, Code
2021, is amended by striking the paragraph and inserting in

Sec. 9. Section 124.204, subsection 4, paragraph u, Code
2021, is amended by striking the paragraph and inserting in
lieu thereof the following:
u. Tetrahydrocannabinols
(1) Meaning tetrahydrocannabinols naturally contained
in a plant of the genus Cannabis (Cannabis plant) as well
as synthetic equivalents of the substances contained in the
Cannabis plant, or in the resinous extractives of such plant,
or synthetic substances, derivatives, and their isomers with
similar chemical structure and pharmacological activity to
those substances contained in the plant, such as the following:
(a) 1 cis or trans tetrahydrocannabinol, and their optical
isomers.
(b) 6 cis or trans tetrahydrocannabinol, and their optical
isomers.
(c) 3, 4 cis or trans tetrahydrocannabinol, and their
optical isomers. (Since nomenclature of these substances
is not internationally standardized, compounds of these
structures, regardless of numerical designation of atomic
positions covered.)
(2) Tetrahydrocannabinols does not include any material,
compound, mixture, or preparation that falls within the
definition of hemp set forth in 7 U.S.C. §1639o.

Sec. 10. Section 124.204, subsection 4, paragraph v, Code
2021, is amended by striking the paragraph and inserting in

alkenyl, akloxyl, hydroxyl, halo, haloalkyl, amino, or nitro
groups.
(3) Substitution in or on the piperidine ring with alkyl,
alkenyl, alkoxyl, ester, ether, hydroxyl, halo, haloalkyl,
amino, or nitro groups.
(4) Replacement of the aniline ring with any aromatic
monocycle whether or not further substituted in or on the
aromatic monocycle.
(5) Replacement of the N-propionyl group by another acyl
group.

except that these substances shall not include the isoquinoline
alkaloids of opium.

retailer, or other person who sells, transfers, or otherwise
furnishes to any person in this state any of the following

Sec. 37. EFFECTIVE DATE. This Act, being deemed of
immediate importance, takes effect upon enactment.
EXPLANATION
The inclusion of this explanation does not constitute agreement with
the explanation’s substance by the members of the general assembly.
This bill relates to controlled substances and precursor
substances, including amending the controlled substance and
precursor substances schedules and including effective date
provisions.
The bill makes changes in Iowa’s uniform controlled
substances Act (Code chapter 124) and precursor substances
(Code chapter 124B) to conform to the specific chemical
designations of the substances contained in Title 21 of
the Code of Federal Regulations (C.F.R.), parts 1300, 1308,
and 1310. The changes include changing some parentheses to
brackets, adding or removing hyphens, and adding or removing
spaces. Additionally, some substances have been moved from the
current location in the Code to a location which corresponds
to those under federal law. Fourteen new substances were
added to the schedule I opiates category, including acetyl
fentanyl which was moved from the “other substances” category.
Marijuana extract, synthetic cathinone, and 21 other substances
were added to the schedule I, hallucinogenic substances
category.
The bill takes effect upon enactment.
