Section
1.
Section
29C.8,
Code
2017,
is
amended
by
adding
1
the
following
new
subsection:

NEW
SUBSECTION
.
6.
The
director
may
establish
permanent
3
emergency
personnel
positions
that
are
directly
related
to
the
4
governor’s
proclamation
of
a
state
of
disaster
emergency
or
5
when
the
president
of
the
United
States
has
declared
a
major
6
disaster
to
exist
in
this
state.
All
such
emergency
personnel
7
shall
be
exempt
from
the
merit
system
described
in
chapter
8A,
8
subchapter
IV,
and
shall
be
excluded
from
collective
bargaining
9
as
described
in
chapter
20.
All
such
emergency
personnel
shall
10
be
classified,
compensated,
and
eligible
to
receive
benefits
in
11
accordance
with
chapter
8A,
subchapter
IV.

EXPLANATION
13
The
inclusion
of
this
explanation
does
not
constitute
agreement
with
14
the
explanation’s
substance
by
the
members
of
the
general
assembly.

This
bill
provides
that
the
director
of
the
department
16
of
homeland
security
and
emergency
management
may
establish
17
permanent
emergency
personnel
positions
that
are
directly
18
related
to
the
governor’s
proclamation
of
a
state
of
disaster
19
emergency
or
when
the
president
of
the
United
States
has
20
declared
a
major
disaster
to
exist
in
this
state.
The
bill
21
provides
that
all
such
emergency
personnel
shall
be
exempt
22
from
the
merit
system
as
provided
in
Code
chapter
8A
and
23
excluded
from
collective
bargaining
under
Code
chapter
20.
The
24
bill
further
provides
that
such
emergency
personnel
shall
be
25
classified,
compensated,
and
eligible
to
receive
benefits
in
26
accordance
with
Code
chapter
8A.
