S.F. 579 Section 1. NEW SECTION . 27A.12 Data collection. 1 Each state or local law enforcement agency subject to this 2 chapter shall do all of the following: 3 1. Collect data relating to the commission of public 4 offenses by nonresident aliens as defined in section 9I.1. 5 Data collected shall include but is not limited to: 6 a. Whether a citation was issued or an arrest was made. 7 b. The type of citation issued or the basis for the arrest. 8 c. Whether the public offense was a misdemeanor or felony. 9 d. Whether the public offense was committed against another 10 person. 11 e. Injuries sustained by another person or a law enforcement 12 officer as a result of or in the course of committing the 13 public offense. 14 f. The type of property seized pursuant to an arrest. 15 2. Data collected pursuant to this section shall be 16 submitted to the division of criminal and juvenile justice 17 planning of the department of human rights as directed by the 18 division. 19 Sec. 2. Section 216A.131A, Code 2019, is amended to read as 20 follows: 21 216A.131A Division of criminal and juvenile justice planning. 22 The division of criminal and juvenile justice planning is 23 established to fulfill the responsibilities of this subchapter , 24 including the duties specified in sections 216A.135 , 216A.136 , 25 216A.137 , 216A.138 , and 216A.139 , and 216A.140A . 26 Sec. 3. NEW SECTION . 216A.140A Nonresident alien public 27 offense research project. 28 1. The division shall establish and maintain a nonresident 29 alien public offense research project to conduct analyses and 30 evaluate the public offense data submitted to the division 31 pursuant to section 27A.12. 32 2. The division shall submit an annual report to the general 33 assembly by January 31 of each year regarding research results 34 and the status of the project. 35 -1- LSB 2535SV (1) 88 as/rn 1/ 2
S.F. 579 EXPLANATION 1 The inclusion of this explanation does not constitute agreement with 2 the explanation’s substance by the members of the general assembly. 3 This bill relates to nonresident alien public offense data 4 collection and analysis. 5 The bill provides that each state or local law enforcement 6 agency subject to Code chapter 27A must collect data relating 7 to the commission of public offenses by nonresident aliens as 8 defined in Code section 9I.1. Data collected shall include 9 whether a citation was issued or an arrest was made, the 10 type of citation issued or the basis for the arrest, whether 11 the public offense was a misdemeanor or felony, whether the 12 public offense was committed against another person, injuries 13 sustained by another person or a law enforcement officer as a 14 result of the public offense, and the type of property seized 15 pursuant to an arrest. 16 The bill requires the public offense data to be submitted to 17 the division of criminal and juvenile justice planning of the 18 department of human rights as directed by the division. The 19 bill provides that the division shall establish and maintain a 20 nonresident alien public offense research project to conduct 21 analyses and evaluate the public offense data submitted to the 22 division by state and local law enforcement agencies.
