Senate File 401 - Reprinted SENATE FILE BY COMMITTEE ON HUMAN RESOURCES (SUCCESSOR TO SSB 1240) (As Amended and Passed by the Senate March 12, 2015) A BILL FOR 1 An Act relating to subacute care facilities. 2 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA: SF 401 (3) 86 rh/rj/jh PAG LIN 1 1 Section 1. Section 135G.6, subsection 2, paragraphs b and c, 1 2 Code 2015, are amended to read as follows: 1 3 b. The department of human services shall not give approval 1 4 to an application which would cause the number of publicly 1 5 funded subacute care facility beds licensed under this chapter 1 6 to exceedfiftyseventy=five beds. 1 7 c. The subacute care facility beds identified bythe 1 8a request for proposals process initiated on or after the 1 9 effective date of this Act shall beexisting beds which have 1 10 been awarded anew beds located in hospitals and facilities 1 11 existing under a current certificate of need pursuant to 1 12 chapter 135. Such beds shall not be required to obtain an 1 13 additional certificate of needupon conversion to licensed 1 14 subacute care facility beds. 1 15 Sec. 2. Section 229.13, subsection 1, Code 2015, is amended 1 16 by adding the following new paragraph: 1 17 NEW PARAGRAPH. c. If the court orders evaluation and 1 18 treatment of the respondent on an inpatient basis under this 1 19 section, the court may order the respondent placed under the 1 20 care of an appropriate subacute care facility licensed under 1 21 chapter 135G. 1 22 Sec. 3. Section 229.14, subsection 2, Code 2015, is amended 1 23 by adding the following new paragraph: 1 24 NEW PARAGRAPH. e. If the court orders placement and 1 25 treatment of the respondent on an inpatient basis under this 1 26 section, the court may order the respondent placed under the 1 27 care of an appropriate subacute care facility licensed under 1 28 chapter 135G. 1 29 Sec. 4. DEPARTMENT OF INSPECTIONS AND APPEALS == 1 30 RULES. The administrative rules adopted by the department of 1 31 inspections and appeals relating to eligibility requirements 1 32 for individualized subacute mental health services in subacute 1 33 care facilities licensed under chapter 135G shall allow for the 1 34 treatment of persons involuntarily hospitalized under chapter 1 35 229.
