S.F. 397 Section 1. Section 99D.7, subsection 5, paragraph b, Code 1 2013, is amended to read as follows: 2 b. The commission shall, beginning January 1, 2012, regulate 3 the purse structure for all horse racing so that seventy-six 4 percent is designated for thoroughbred racing, fifteen and 5 one-quarter percent is designated for quarter horse racing, and 6 eight and three-quarter three-quarters percent is designated 7 for standardbred racing. The purse moneys designated for 8 standardbred racing may only be used to support standardbred 9 harness racing purses at the state fair, county fairs, or 10 other harness racing tracks approved by the commission, or for 11 the construction, maintenance , or repair of harness racing 12 tracks located in Iowa and at the fairgrounds for such fairs 13 or other harness racing tracks located in Iowa and approved by 14 the commission. The horse racetrack in Polk county shall not 15 provide funding to support standardbred racing at such county 16 fairs that is not otherwise provided for in this paragraph. 17 Sec. 2. Section 99D.11, subsection 6, paragraph c, 18 subparagraph (4), Code 2013, is amended to read as follows: 19 (4) An unlicensed advance deposit wagering operator or an 20 individual taking or receiving wagers from residents of this 21 state on races conducted at the horse racetrack located in Polk 22 county is guilty of a class “D” felony. 23 Sec. 3. Section 99D.25A, subsection 2, Code 2013, is amended 24 to read as follows: 25 2. Phenylbutazone shall not be administered to a horse 26 in dosages which would result in concentrations of more 27 than five micrograms of the substance or its metabolites per 28 milliliter of blood. In races recognized as graded stakes 29 thoroughbred races, the commission may establish restrictions 30 on dosage amounts for phenylbutazone which would result in 31 concentrations of less than five micrograms of the substance or 32 its metabolites per milliliter of blood. 33 EXPLANATION 34 This bill concerns pari-mutuel wagering and horse racing. 35 -1- LSB 2107SV (2) 85 ec/nh 1/ 2
S.F. 397 Code section 99D.7(5), concerning purse moneys for horse 1 racing, is amended to allow purse moneys designated for 2 standardbred racing to be used for the construction of harness 3 racing tracks. 4 Code section 99D.11(6)(c)(4), governing penalties for 5 advance deposit wagering violations, is amended by striking the 6 provision that the current penalty for unlawful advance deposit 7 wagering applies to taking wagers only on races conducted in 8 Polk county. 9 Code section 99D.25A is amended to allow the racing and 10 gaming commission to establish restrictions on dosage amounts 11 for phenylbutazone in races recognized as graded stakes 12 thoroughbred races. 13 -2- LSB 2107SV (2) 85 ec/nh 2/ 2
