subsection
3,
Code
2019,
is

amended
by
adding
the
following
new
paragraph:

PARAGRAPH
.
c.
Rules
shall
not
be
adopted
that
require

an
owner
of
a
secondary
biofilter
system
that
uses
peat
moss
4
or
cocopeat
to
enter
into
a
maintenance
contract.
However,
a
5
person
who
owns
a
secondary
biofilter
system
that
uses
peat
6
moss
or
cocopeat
shall
have
their
system
inspected
and,
if
7
necessary,
have
maintenance
performed
by
a
certified
technician
8
at
least
once
every
five
years.

EXPLANATION

The
inclusion
of
this
explanation
does
not
constitute
agreement
with
11
the
explanation’s
substance
by
the
members
of
the
general
assembly.

This
bill
relates
to
rules
related
to
the
maintenance
of
13
septic
systems.

Current
law
requires
the
environmental
protection
commission
15
to
establish
rules
relating
to
the
maintenance
of
disposal
16
systems.
The
bill
prohibits
the
commission
from
adopting
rules
17
that
require
an
owner
of
a
secondary
biofilter
system
that
18
uses
peat
moss
or
cocopeat
from
entering
into
a
maintenance
19
contract.
However,
the
bill
requires
an
owner
of
a
peat
moss
20
biofilter
system
or
a
cocopeat
biofilter
system
to
have
the
21
system
inspected
and,
if
necessary,
have
maintenance
performed
22
by
a
certified
technician
at
least
once
every
five
years.
