  1 An Act relating to school district elections to authorize the
  2    issuance of certain indebtedness and including effective
  3    date and applicability provisions.

  1  1    Section 1.  Section 296.3, Code 2015, is amended to read as
  1  2 follows:
  1  3    296.3  Election called.
  1  4    1.  Within ten days of receipt of a petition filed under
  1  5 section 296.2, the president of the board of directors shall
  1  6 call a meeting of the board. The meeting shall be held within
  1  7 thirty days after the petition was received. At the meeting,
  1  8 the board shall call the election, fixing the time of the
  1  9 election, which may, subject to the limitation in subsection 2,
  1 10  be at the time and place of holding the regular school election
  1 11  on a date specified in section 39.2, subsection 4, paragraph
  1 12 "c". However, if the board determines by unanimous vote that
  1 13 the proposition or propositions requested by a petition to be
  1 14 submitted at an election are grossly unrealistic or contrary
  1 15 to the needs of the school district, no election shall be
  1 16 called. If more than one petition has been received by the
  1 17 time the board meets to consider the petition triggering the
  1 18 meeting, the board shall act upon the petitions in the order
  1 19 they were received at the meeting called to consider the
  1 20 initial petition. The decision of the board may be appealed to
  1 21 the state board of education as provided in chapter 290. The
  1 22 president shall notify the county commissioner of elections of
  1 23 the time of the election.
  1 24    2.  The date of an election fixed by the board of directors
  1 25 under subsection 1 shall be a date that is not less than one
  1 26 year after the date of the last election held on a proposition
  1 27 under this chapter.
  1 28    Sec. 2.  EFFECTIVE UPON ENACTMENT.  This Act, being deemed of
  1 29 immediate importance, takes effect upon enactment.
  1 30    Sec. 3.  APPLICABILITY.  This Act applies to propositions
  1 31 submitted to voters at an election held on or after the
  1 32 effective date of this Act.
  1 33                           EXPLANATION
  1 34 The inclusion of this explanation does not constitute agreement with
  1 35 the explanation's substance by the members of the general assembly.
  2  1 This bill relates to school district elections to authorize
  2  2 the issuance of indebtedness and general obligation bonds under
  2  3 Code chapter 296.
  2  4    Code chapter 296 authorizes the issuance of such
  2  5 indebtedness and bonds to defray the cost of purchasing,
  2  6 building, furnishing, reconstructing, repairing, improving or
  2  7 remodeling a schoolhouse or schoolhouses and additions thereto,
  2  8 gymnasium, stadium, field house, school bus garage, teachers'
  2  9 or superintendent's home or homes, and procuring a site or
  2 10 sites therefor, or purchasing land to add to a site already
  2 11 owned, or procuring and improving a site for an athletic field,
  2 12 or improving a site already owned for an athletic field, and
  2 13 for any one or more of such purposes.
  2 14    Current Code section 296.3 specifies the procedure and
  2 15 requirements used by a school board in fixing the time for an
  2 16 election after receiving a petition calling for an election on
  2 17 the issuance of indebtedness or bonds in excess of 1.25 percent
  2 18 of the assessed value of the taxable property in the school
  2 19 district.  The bill provides that the date of the election
  2 20 may be held on a special election date specified in Code
  2 21 section 39.2(4)(c).  The bill also provides that the date of an
  2 22 election fixed by the school board must be a date that is not
  2 23 less than one year after the date of the last election held on a
  2 24 proposition under Code chapter 296.
  2 25    The bill takes effect upon enactment and applies to
  2 26 propositions submitted to voters at an election held on or
  2 27 after the effective date of the bill.
