Section
1.
Section
714.1,
subsection
1,
Code
2019,
is

amended
to
read
as
follows:

1.
Takes
possession
or
control
of
the
property
of
another,
3
or
property
in
the
possession
of
another,
with
the
intent
to
4
deprive
the
other
thereof.
In
the
case
of
a
motor
vehicle
as
5
defined
in
chapter
321,
depriving
another
of
the
possession
or
6
control
of
a
motor
vehicle
for
six
or
more
hours
establishes
7
the
intent
to
deprive
the
other
person
of
possession
or
control
8
of
such
property.

The
inclusion
of
this
explanation
does
not
constitute
agreement
with

the
explanation’s
substance
by
the
members
of
the
general
assembly.

This
bill
relates
to
theft
and
the
intent
to
deprive
a
person

of
the
possession
or
control
of
certain
property.

The
bill
provides
that
in
the
case
of
a
motor
vehicle
15
as
defined
in
Code
chapter
321,
depriving
another
of
the
16
possession
or
control
of
a
motor
vehicle
for
six
or
more
17
hours
establishes
the
intent
to
deprive
the
other
person
of
18
possession
or
control
of
such
property.
19
Theft
of
a
motor
vehicle
carries
a
penalty
from
a
class
“C”
20
felony
down
to
a
simple
misdemeanor
depending
on
the
value
of
21
the
motor
vehicle.
