  1 An Act providing for standards and requirements for threat
  2    detection and response for design and construction of school
  3    buildings.
  4 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

  1  1    Section 1.  Section 103A.7, subsection 2, Code 2015, is
  1  2 amended by adding the following new paragraph:
  1  3    NEW PARAGRAPH.  i.  Standards for threat detection and
  1  4 response for public and nonpublic school buildings used for
  1  5 kindergarten through grade twelve instruction.
  1  6    Sec. 2.  NEW SECTION.  103A.8D  Safety enhancements for new
  1  7 schools.
  1  8    1.  The commissioner, after consulting with and receiving
  1  9 recommendations from the state board of education, shall
  1 10 adopt rules pursuant to chapter 17A specifying standards and
  1 11 requirements for threat detection and response for design and
  1 12 construction of public and nonpublic school buildings used for
  1 13 kindergarten through grade twelve instruction. The standards
  1 14 and requirements shall be incorporated into the state building
  1 15 code adopted in section 103A.7. The standards and requirements
  1 16 shall include design provisions to enhance the overall safety
  1 17 and well=being of students and staff, including but not limited
  1 18 to the following safety enhancements:
  1 19    a.  Surveillance video.
  1 20    b.  Entry way metal detectors.
  1 21    c.  Direct entrance and exit routes located within a
  1 22 classroom, which can only be accessed from inside that
  1 23 classroom.
  1 24    d.  An effective means of communication between classrooms
  1 25 and administrative offices.
  1 26    e.  A real=time notification device located within a
  1 27 classroom, such as a panic button, to alert local area law
  1 28 enforcement when a staff member encounters a dangerous
  1 29 situation.
  1 30    f.  A means of threat containment, which may include the
  1 31 ability to lock down the portion of a building wherein a threat
  1 32 has been identified.
  1 33    2.  The rules shall require public and nonpublic school
  1 34 buildings used for kindergarten through grade twelve
  1 35 instruction to include at least two of the safety enhancements
  2  1 described in subsection 1. The standards shall also
  2  2 expressly permit such a building to include more than two such
  2  3 enhancements.
  2  4    3.  The commissioner shall require compliance with the rules
  2  5 adopted pursuant to this section for construction of public and
  2  6 nonpublic school buildings used for kindergarten through grade
  2  7 twelve instruction commenced on or after July 1, 2016.
  2  8    Sec. 3.  Section 256.7, Code 2015, is amended by adding the
  2  9 following new subsection:
  2 10    NEW SUBSECTION.  33.  Advise the state building code
  2 11 commissioner in the development of standards and requirements
  2 12 for threat detection and response for design and construction
  2 13 of public and nonpublic school buildings used for kindergarten
  2 14 through grade twelve instruction as provided in section
  2 15 103A.8D.
  2 16    Sec. 4.  IMPLEMENTATION OF ACT.  Section 25B.2, subsection
  2 17 3, shall not apply to this Act.
  2 18                           EXPLANATION
  2 19 The inclusion of this explanation does not constitute agreement with
  2 20 the explanation's substance by the members of the general assembly.
  2 21    This bill requires the state building commissioner, after
  2 22 consulting with and receiving recommendations from the state
  2 23 board of education, to adopt rules specifying standards and
  2 24 requirements for threat detection and response for design and
  2 25 construction of public and nonpublic school buildings used for
  2 26 kindergarten through grade 12 instruction. The standards and
  2 27 requirements shall be incorporated into the state building
  2 28 code. The standards and requirements shall include design
  2 29 provisions to enhance the overall safety and well=being of
  2 30 students and staff, including certain safety enhancements.
  2 31    Safety enhancements described in the bill include but are
  2 32 not limited to surveillance video; entry way metal detectors;
  2 33 direct entrance and exit routes located within a classroom,
  2 34 which can only be accessed from inside that classroom; an
  2 35 effective means of communication between classrooms and
  3  1 administrative offices; a real=time notification device located
  3  2 within a classroom, such as a panic button; and a means of
  3  3 threat containment, which may include the ability to lock down
  3  4 the portion of a building wherein a threat has been identified.
  3  5    The rules shall require public and nonpublic school
  3  6 buildings used for kindergarten through grade 12 instruction to
  3  7 include at least two of the safety enhancements described in
  3  8 the bill and expressly permit such a building to include more
  3  9 than two such enhancements.
  3 10    The commissioner shall require compliance with the rules
  3 11 adopted pursuant to the bill for construction of public and
  3 12 nonpublic school buildings used for kindergarten through grade
  3 13 12 instruction commenced on or after July 1, 2016.
  3 14    The bill may include a state mandate as defined in Code
  3 15 section 25B.3.  The bill makes inapplicable Code section 25B.2,
  3 16 subsection 3, which would relieve a political subdivision from
  3 17 complying with a state mandate if funding for the cost of
  3 18 the state mandate is not provided or specified.  Therefore,
  3 19 political subdivisions are required to comply with any state
  3 20 mandate included in the bill.
