Senate File 2321 - Introduced SENATE FILE BY COMMITTEE ON JUDICIARY (SUCCESSOR TO SSB 3101) A BILL FOR 1 An Act excluding persons going armed with certain portable 2 devices or weapons that direct an electric current from 3 the criminal offense of carrying weapons under certain 4 circumstances. 5 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA: TLSB 6140SV (2) 87 jm/rh PAG LIN 1 1 Section 1. Section 724.4, subsection 4, Code 2018, is 1 2 amended by adding the following new paragraph: 1 3 NEW PARAGRAPH. l. A person who goes armed with a dangerous 1 4 weapon that directs an electric current, impulse, wave, or beam 1 5 that produces a high=voltage pulse designed to immobilize a 1 6 person, as long as such a dangerous weapon does not generate a 1 7 projectile that directs an electric current, impulse, wave, or 1 8 beam that produces a high=voltage pulse designed to immobilize 1 9 a person, and such a dangerous weapon is not used in the 1 10 commission of a public offense. 1 11 EXPLANATION 1 12 The inclusion of this explanation does not constitute agreement with 1 13 the explanation's substance by the members of the general assembly. 1 14 This bill excludes persons going armed with certain 1 15 portable devices or weapons that direct an electric current 1 16 from the criminal offense of carrying weapons under certain 1 17 circumstances. 1 18 Under the bill, a person does not commit the criminal offense 1 19 of carrying weapons if the person goes armed with a dangerous 1 20 weapon that directs an electric current, impulse, wave, or beam 1 21 that produces a high=voltage pulse designed to immobilize a 1 22 person, as long as such a dangerous weapon does not generate 1 23 a projectile that directs an electric current, impulse, 1 24 wave, or beam that produces a high=voltage pulse designed to 1 25 immobilize a person, and such dangerous weapon is not used in 1 26 the commission of a public offense. 1 27 Currently, such a person commits the criminal offense of 1 28 carrying weapons which is an aggravated misdemeanor. An 1 29 aggravated misdemeanor is punishable by confinement for no more 1 30 than two years and a fine of at least $625 but not more than 1 31 $6,250. LSB 6140SV (2) 87 jm/rh
