  1  1    Section 1.  NEW SECTION.  216.9A  Multiple occupancy toilet
  1  2 facilities in schools == use by persons of same biological sex.
  1  3    It shall not be an unfair or discriminatory practice for a
  1  4 school to require a multiple occupancy toilet facility to be
  1  5 designated only for and used by persons of the same biological
  1  6 sex as provided in section 280.30.  It shall not be an unfair
  1  7 or discriminatory practice to prohibit a person from using a
  1  8 multiple occupancy toilet facility that does not correspond
  1  9 with the person's biological sex as provided in section 280.30.
  1 10    Sec. 2.  NEW SECTION.  280.30  Multiple occupancy toilet
  1 11 facilities == use by persons of same biological sex.
  1 12    1.  As used in this section:
  1 13    a.  "Biological sex" means the physical condition of being
  1 14 male or female as indicated on a person's birth certificate.
  1 15    b.  "Multiple occupancy toilet facility" means a toilet
  1 16 facility designed or designated to be used by more than one
  1 17 person at a time.
  1 18    c.  "School" means an elementary or secondary public or
  1 19 nonpublic school as described in this chapter.
  1 20    2.  A school shall require a multiple occupancy toilet
  1 21 facility to be designated only for and used by persons of
  1 22 the same biological sex. A person shall not enter a school
  1 23 multiple occupancy toilet facility that does not correspond
  1 24 with the person's biological sex.
  1 25                           EXPLANATION
  1 26 The inclusion of this explanation does not constitute agreement with
  1 27 the explanation's substance by the members of the general assembly.
  1 28    This bill requires elementary and secondary public and
  1 29 nonpublic schools to designate and allow the use of multiple
  1 30 occupancy toilet facilities only by persons of the same
  1 31 biological sex.  The bill prohibits a person from entering
  1 32 a school multiple occupancy toilet facility that does not
  1 33 correspond with the person's biological sex.  The bill provides
  1 34 that such designations and prohibitions do not constitute
  1 35 unfair or discriminatory practices in violation of the Iowa
  2  1 civil rights Act, Code chapter 216.
