  1 An Act relating to expert witness fees.
  2 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

  1  1    Section 1.  Section 622.72, Code 2015, is amended to read as
  1  2 follows:
  1  3    622.72  Expert witnesses == fee fees.
  1  4    Witnesses called to testify only to an opinion founded
  1  5 on special study or experience in any branch of science, or
  1  6 to make scientific or professional examinations and state
  1  7 the result thereof, or for whom a statement is admitted
  1  8 into evidence as a health care provider statement in lieu of
  1  9 testimony pursuant to rule of civil procedure 1.281, shall
  1 10 receive additional compensation fees, to be fixed by the court,
  1 11 with reference to the value of the time employed and the degree
  1 12 of learning or skill required; but such additional compensation
  1 13  fees shall not exceed one hundred fifty two thousand five
  1 14 hundred dollars per day while so employed.  A party seeking
  1 15 approval of expert witness fees under this section shall make
  1 16 an application to the court for a fair, reasonable fee, to be
  1 17 awarded as court costs upon the direction of the court, not to
  1 18 exceed the amount specified in this section.
