  1 An Act relating to licensing fees collected by the board of
  2    educational examiners, nullifying related administrative
  3    rules, and including effective date and retroactive
  4    applicability provisions.
  5 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

  1  1    Section 1.  Section 272.10, subsection 2, Code 2016, is
  1  2 amended to read as follows:
  1  3    2.  Licensing fees are payable to the treasurer of state and
  1  4 shall be deposited with the executive director of the board.
  1  5 The executive director shall deposit twenty=five percent of
  1  6 the fees collected annually with the treasurer of state and
  1  7 the fees shall be credited to the general fund of the state.
  1  8 The remaining licensing fees collected during the fiscal year
  1  9 shall be retained by and are appropriated to the board for
  1 10 the purposes related to the board's duties. Notwithstanding
  1 11 section 8.33, licensing fees retained by and appropriated to
  1 12 the board pursuant to this section that remain unencumbered or
  1 13 unobligated at the close of the fiscal year shall not revert
  1 14 but shall remain available for expenditure for the activities
  1 15 of the board as provided in this chapter until the close of the
  1 16 succeeding fiscal year.  However, the maximum amount that may
  1 17 be carried over to the succeeding fiscal year in accordance
  1 18 with this subsection shall not exceed six hundred fifty
  1 19 thousand dollars.  Any unencumbered or unobligated licensing
  1 20 fees in excess of six hundred fifty thousand dollars at the
  1 21 close of the fiscal year shall revert to the general fund of
  1 22 the state.
  1 23    Sec. 2.  Section 272.10, Code 2016, is amended by adding the
  1 24 following new subsection:
  1 25    NEW SUBSECTION.  5.  For the fiscal years beginning July
  1 26 1, 2015, and July 1, 2016, the board of educational examiners
  1 27 shall not increase its licensing fees as they exist for the
  1 28 fiscal year ending June 30, 2015.
  1 29    Sec. 3.  BOARD OF EDUCATIONAL EXAMINERS == RULE
  1 30 NULLIFICATION.  The amendments to 282 Iowa administrative code,
  1 31 chapter 12, as appearing in ARC 2229C, as published in the
  1 32 Iowa administrative bulletin, volume XXXVIII, number 10, dated
  1 33 November 11, 2015, pp. 804=805, are nullified.
  1 34    Sec. 4.  EFFECTIVE UPON ENACTMENT.  This Act, being deemed of
  1 35 immediate importance, takes effect upon enactment.
  2  1    Sec. 5.  RETROACTIVE APPLICABILITY.  This Act applies
  2  2 retroactively to January 1, 2016.
