S.F. 2147 Section 1. DEPARTMENT OF HUMAN SERVICES —— ELIGIBILITY 1 DETERMINATION FOR MEDICAID FOR EMPLOYED PEOPLE WITH 2 DISABILITIES PROGRAM. 3 1. The department of human services shall adopt rules 4 for initial and continuing eligibility for the Medicaid for 5 employed people with disabilities program as follows: 6 a. The rules shall provide for a disregard in the 7 computation of unearned income due to any increase in unearned 8 income attributable to any social security cost-of-living 9 adjustment increase of the individual or member of the 10 individual’s family whose unearned income is included in the 11 calculation of gross income eligibility. 12 b. The rules shall provide for continuation of transitional 13 Medicaid coverage for a period of twelve months for an 14 individual whose coverage would otherwise be terminated based 15 on a reported increase in earned income from employment for 16 the individual or member of the individual’s family whose 17 earned income is included in the calculation of gross income 18 eligibility. The twelve months of transitional coverage begin 19 the day following the day coverage would otherwise have been 20 terminated. 21 2. The department shall amend the Medicaid state plan as 22 necessary to implement this section. 23 EXPLANATION 24 This bill includes provisions relating to the determination 25 of eligibility for individuals for the Medicaid for employed 26 people with disabilities (MEPD) program. The bill directs the 27 department of human services (DHS) to adopt rules for initial 28 and continuing eligibility for the MEPD program as follows: 29 1. To provide for a disregard in the computation of unearned 30 income due to any increase in unearned income attributable 31 to any social security cost-of-living adjustment increase of 32 the individual or member of the individual’s family whose 33 unearned income is included in the calculation of gross income 34 eligibility. 35 -1- LSB 5963XS (2) 84 pf/nh 1/ 2

To provide for continuation of transitional Medicaid 1 coverage for a period of 12 months for an individual whose 2 coverage would otherwise be terminated based on a reported 3 increase in earned income from employment for the individual 4 or member of the individual’s family whose earned income is 5 included in the calculation of gross income eligibility.
