  2 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

  1  1    Section 1.  NEW SECTION.  135C.24A  Nursing facility security
  1  2 deposits.
  1  3    1.  If a nursing facility requires a security deposit
  1  4 prior to an individual's admission to the nursing facility,
  1  5 the nursing facility shall, within thirty days from the date
  1  6 the individual is discharged or transferred from the nursing
  1  7 facility, return the security deposit to the individual less
  1  8 any charges expended in accordance with the terms of the
  1  9 nursing facility contract.
  1 10    2.  The department shall adopt rules to implement this
  1 11 section.
  1 12                           EXPLANATION
  1 13 The inclusion of this explanation does not constitute agreement with
  1 14 the explanation's substance by the members of the general assembly.
  1 15    This bill provides that if a nursing facility requires a
  1 16 security deposit prior to an individual's admission to the
  1 17 nursing facility, the nursing facility shall, within 30 days
  1 18 from the date the individual is discharged or transferred
  1 19 from the nursing facility, return the security deposit to the
  1 20 individual less any charges expended in accordance with the
  1 21 terms of the nursing facility contract.  The bill directs
  1 22 the department of inspections and appeals to adopt rules to
  1 23 implement the bill.
  1 24    "Nursing facility" means an institution or a distinct
  1 25 part of an institution housing three or more individuals not
  1 26 related to the administrator or owner within the third degree
  1 27 of consanguinity, which is primarily engaged in providing
  1 28 health=related care and services, including rehabilitative
  1 29 services, but which is not engaged primarily in providing
  1 30 treatment or care for mental illness or an intellectual
  1 31 disability, for a period exceeding 24 consecutive hours for
  1 32 individuals who, because of a mental or physical condition,
  1 33 require nursing care and other services in addition to room and
  1 34 board.
