  1 An Act requiring certain city utility boards to submit

  4 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

  1  1    Section 1.  Section 388.4, Code 2016, is amended by adding
  1  2 the following new subsection:
  1  3    NEW SUBSECTION.  5.  A utility board established by a city
  1  4 with more than one hundred seventy=five thousand population,
  1  5 located in a county with more than four hundred thousand
  1  6 population, shall submit to the city council for review and
  1  7 approval, in advance of payment, each request for payment of
  1  8 attorney fees and related litigation expenses in excess of ten
  1  9 thousand dollars arising out of or related to any one civil
  1 10 case or administrative proceeding to which the utility board or
  1 11 the city utility, city utilities, or combined utility system
  1 12 is a party.
  1 13                           EXPLANATION
  1 14 The inclusion of this explanation does not constitute agreement with
  1 15 the explanation's substance by the members of the general assembly.
  1 16    This bill requires city utility boards in cities and
  1 17 counties exceeding a specified population threshold to submit
  1 18 advanced payment requests for certain expenses to the city
  1 19 council for approval.
  1 20    The bill provides that a utility board established by a city
  1 21 with a population exceeding 175,000 residents and located in
  1 22 a county with a population exceeding 400,000 residents must
  1 23 submit to the city council for review and approval, in advance
  1 24 of payment, each request for payment of attorney's fees and
  1 25 related litigation expenses in excess of $10,000 arising out of
  1 26 or related to any one civil case or administrative proceeding
  1 27 to which the utility board or the city utility, city utilities,
  1 28 or combined utility system is a party.
