Senate File 2075 - Introduced SENATE FILE BY HOGG A BILL FOR 1 An Act relating to the three=month retroactive Medicaid 2 coverage benefit, and including effective date provisions. 3 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA: TLSB 5812XS (2) 87 pf/rh PAG LIN 1 1 Section 1. 2017 Iowa Acts, chapter 174, section 12, 1 2 subsection 15, paragraph a, subparagraph (7), is amended by 1 3 striking the subparagraph. 1 4 Sec. 2. THREE=MONTH RETROACTIVE MEDICAID COVERAGE 1 5 BENEFIT. The department of human services shall adopt 1 6 emergency rules pursuant to chapter 17A and shall seek a 1 7 waiver from the centers for Medicare and Medicaid services of 1 8 the United States department of health and human services to 1 9 reinstate and implement the three=month retroactive Medicaid 1 10 coverage benefit for Medicaid applicants effective July 1, 1 11 2018. 1 12 Sec. 3. EFFECTIVE DATE. This Act, being deemed of immediate 1 13 importance, takes effect upon enactment. 1 14 EXPLANATION 1 15 The inclusion of this explanation does not constitute agreement with 1 16 the explanation's substance by the members of the general assembly. 1 17 This bill strikes the provision in the 2017 Iowa Acts that 1 18 directed the department of human services (DHS) to eliminate 1 19 the three=month retroactive Medicaid coverage benefit and 1 20 directs DHS to adopt emergency rules and seek a waiver from the 1 21 centers for Medicare and Medicaid services of the United States 1 22 department of health and human services (CMS) to reinstate and 1 23 implement the three=month retroactive Medicaid coverage benefit 1 24 for Medicaid applicants effective July 1, 2018.
